TERMS OF PARTICIPATION – ‘YOU’ TRY IT, RATE IT PROGRAM
• Registration for the “YOU Try it, Rate it” program (“the Program”) is open to all residents of Australia. The Program is administered by FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (“Foxtel”). Participation in the Program is deemed acceptance of these Terms of Participation.
• The officers, management and employees (or immediate family of an officer, manager or employee) of Foxtel, the agencies associated with the Program, Foxtel, Telstra or Optus TV and their related bodies corporate are not eligible to participate.
TERMS OF PARTICIPATION – ‘YOU’ TRY IT, RATE IT PROGRAM
• Registration for the “YOU Try it, Rate it” program (“the Program”) is open to all residents of Australia. The Program is administered by FOXTEL Management Pty Ltd (ABN: 65 068 671 938) of 5 Thomas Holt Drive, North Ryde NSW 2113, Australia (“Foxtel”). Participation in the Program is deemed acceptance of these Terms of Participation.
• The officers, management and employees (or immediate family of an officer, manager or employee) of Foxtel, the agencies associated with the Program, Foxtel, Telstra or Optus TV and their related bodies corporate are not eligible to participate.
• The Program begins at 12:01 am (AEDT) on 16/03/15 and closes at 11.59pm (AEDT) on 22/03/15 (the “Program Period”).
• There are 29 products to be reviewed in total, consisting of the following:
(a) 8 x OptiDerma Skincare Packs, valued at a maximum of $67.75 each (the “Product”).
(b) 15 x Double Passes to see A Little Chaos, valued at a maximum of $38.00 each (the “Product”).
(c) 1 x Skywatch Chronograph All Black Dive Watch, valued at a maximum of $495.00. (the “Product”).
(d) 5 x Milkman Australia Mens Grooming Sets, valued at a maximum of $112.00 each. (the “Product”).
• A pre-determined number of people who have registered for the Program will be randomly selected to review the Product, subject to meeting the requirements under these Terms of Participation (“YOU Reviewer”). The YOU Reviewers will be randomly selected by Red Promotions (ABN: 18 204 124 053) of, Lilyfield NSW, 2034. By entering the Program, participants agree to have their personal information passed onto Red Promotions for the purpose of selecting the YOU Reviewers. Foxtel accepts no responsibility for any other use of the YOU Reviewers’ personal information by Red Promotions.
• To become a YOU Reviewer, participants must:
(a) Go to the YOU Try It, Rate It official page www.lifestyle.com.au/you/tryitrateit/
(b) Complete the registration form with the details required, including (but not limited to) full name, address, email address and phone number. Mandatory details will be indicated on the form.
(c) Fulfil the age or other criteria specified for the Product; and if chosen as a YOU Reviewer, complete a written review of the Product which complies with all review instructions and guidelines supplied by or on behalf of Foxtel (“Product Review”).
• All registrations must include the entrant’s name, residential address (PO boxes will not be accepted), postcode, daytime phone number (including area code), mobile phone number, email address and date of birth to be eligible for the Program. Incomplete entries will be ineligible. It is the entrant’s responsibility to inform Foxtel if their residential address or contact number changes during the Program Period.
• Entrants may register for a Try It, Rate It program as many times as they like. Entrants that are selected to be a reviewer will be provided with one Product to review. Each Entrant can only be selected as a reviewer once per program.
• The Product is not transferable or redeemable for cash. The value given is the recommended retail value as provided by the supplier and is correct at the time of publication on the LifeStyle YOU website. The Product cannot be exchanged for any other Product. The contents of the Product will be at Foxtel’s sole discretion. Selection of YOU Reviewers is subject to availability of the Product and the terms and conditions of the entity supplying the Product. In the event that the Product becomes unavailable, for whatever reason, Foxtel reserves the right not to substitute the Product for an alternative Product/s.
• Those participants who are selected to be a YOU Reviewer will be notified by an electronic card (ecard) sent to the YOU Reviewer’s email address at or around 5.00pm (AEDT/AEST) on 23/03/15.
• Following notification by Foxtel (or Foxtel’s agent) that a participant has been selected as a YOU Reviewer, the supplier will endeavour to send the Product to the YOU Reviewer at the YOU Reviewer’s nominated residential address within 28 days, subject to any special provisions relating to the Product. If a selected YOU Reviewer cannot be contacted or the supplier is unable to deliver the Product to the YOU Reviewer, then the Product will not be offered to the YOU Reviewer for the purposes of a Product Review.
• It is a condition of accepting the Product to review that the YOU Reviewer must comply with all the conditions of use of the Product imposed by Foxtel or the Supplier. The Product must be taken as stated and no compensation will be payable if a YOU Reviewer is unable to use the Product as stated.
• YOU Reviewers must submit a valid review to the LifeStyle YOU website via the link provided on the confirmation ecard or by following the links on the LifeStyle YOU website within 21 days of receiving the Product or date given on ecard in order to be eligible to review any future products. YOU Reviewers who do not satisfy review requirements by the stipulated date will be removed from the validated reviewing list immediately. No responsibility will be taken by Foxtel for any changes in dates, times or cancellations or other arrangements that may prevent the YOU Reviewers from reviewing the Product.
• Foxtel, or the Foxtel’s agent, will select a maximum of three Product Reviews for the Product (at its sole discretion) which will be published on the LifeStyle YOU website and otherwise communicated to the public in any media by Foxtel. Any Product Review which contains defamatory, offensive or pre-used material or which infringes the intellectual property rights of any person or which is otherwise deemed unsuitable for publication by Foxtel (in its absolute discretion) will be ineligible for publication and those YOU Reviewers will be removed from the validated reviewing list immediately.
• By submitting a Product Review, each YOU Reviewer warrants that their entry is their own original work, and that they own all rights, including copyright, in their entry. Each YOU Reviewer will indemnify and keep indemnified Foxtel in the event that this warranty is false.
• YOU Reviewers acknowledge that all registrations and all Product Reviews become the property of Foxtel and may be communicated to the public by Foxtel or used for promotional purposes in any media at any time. By participating in the Program, YOU Reviewers agree to grant Foxtel an irrevocable, non-exclusive, perpetual, worldwide, transferable, and royalty free license to use, reproduce, distribute, prepare derivative works of and display their Product Review, image and/or photograph without compensation for the purposes of conducting and promoting this Program, awarding the Product and advertising and marketing the Promoter or the Program on all media now know or later devised, in perpetuity.
• By entering the Program, YOU Reviewers consent to any use of their Review by the Promoter which may otherwise infringe a YOU Reviewer’s moral rights in the Review, including (without limitation);
o Exercising any of the rights in the Review without identifying the YOU Reviewer; and
o Using the Review in any way that the Promoter sees fit, even if it results in derogatory treatment of the Review (as defined in the Copyright Act 1968 (Cth).
• Some Products may require an element of travel, for example if a YOU Reviewer is required to do a Product Review for a spa treatment. All ancillary costs incurred in taking and using such Products (including, but not limited to, travel and meals) are the responsibility of the YOU Reviewer, unless expressly stated as being part of the Product.
• Participants who are under 18 years of age are required to check the description of the Product on the Lifestyle YOU website (www.lifestyle.com.au/you/tryitrateit) for details of any age restrictions which may apply to the particular Product. Participants who are under the age of 18 are not eligible to be a YOU Reviewer for a Product where that Product does have age restrictions.
• All participants agree to provide the Foxtel or Foxtel’s authorised agent with proof of identity, residency, age and/or proof of entry validity if selected as a YOU Reviewer or if reasonably requested by Foxtel or Foxtel’s authorised agent. In the event that a YOU Reviewer cannot provide suitable proof, the YOU Reviewer will be ineligible to participate in the Program.
• No responsibility will be taken by Foxtel, Telstra or Optus TV for any changes in dates, times or cancellations or other arrangements that may prevent a participant from becoming a YOU Reviewer.
• It is a condition of entering the Program that those participants selected to be YOU Reviewers may be required to sign a legal release in a form determined by Foxtel in its absolute discretion.
• Foxtel reserves the right, in its absolute discretion, at any time during the Program, to cancel or vary the terms of the Program or the Product, including without limitation, circumstances where in Foxtel’s opinion (which it shall form in its absolute discretion):
(a) a participant/YOU Reviewer does not satisfy the Program entry requirements or Product conditions; or
(b) Foxtel cannot conduct the Program for any reason beyond its control.
• In the event that Foxtel cancels or varies the Program, it shall not:
(a) be liable to any person for any loss or damage (including loss or damage caused by negligence) arising out of, or in connection with such cancellation, variation or withdrawal; and
(b) be required to conduct the Program at any other time.
• Any decision by Foxtel in relation to the conduct of the Program is binding and conclusive and no correspondence will be entered into.
• Participants enter the Program at their sole risk. To the extent permitted by law, Foxtel shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss or personal injury suffered or sustained by any participant and/or YOU Reviewer during the course of the Program or in connection with any use of the Product.
• YOU Reviewers agree to release and hold harmless Foxtel and its subsidiaries and affiliates, and each of their respective parent companies and each such company's officers, directors, shareholders, employees and agents from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of use of the Product as part of this Program.
