Entertainment Inc. “TODAY SHOW AQUAMAN” PROMOTION TERMS AND CONDITIONS 1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is only open to Australian residents aged 18 years or over who are available to take the prize in October 2017 on dates advised by the Promoter. 3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step- grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step- sister or 1 st cousin. 4. Promotion commences 5:30am AEST on 11/09/17 and closes 4:00pm AEST on 15/09/17 (“Promotional Period”). 5. To enter, eligible entrants must, during the Promotional Period, visit www.9now.com.au/today, locate the promotional entry form, complete all requested details including, but not limited to, full name, address, contact number, valid and current email address, confirmation of their availability to take the prize if drawn as a winner, and an answer to the question in 25 words or less “Why would you like to be an extra in Aquaman?” and submit the completed form. 6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 7. Incomplete or indecipherable entries will be deemed invalid. 8. Only one (1) entry permitted per entrant. 9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 10. The judging will take place at 24 Artarmon Road, Willoughby NSW 2068 on 18/09/17 at 10:00am AEST. The judges may select additional reserve entries that they determine to be the next best, and record them in order of merit, in 2 case of an invalid entry or ineligible entrant. The winners will be notified by telephone and email. 11. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on artistic and creative merit of the Photograph provided. 12. The Promoter’s decision is final and no correspondence will be entered into. 13. The best valid entry, as determined by the judges, will win a trip to the Gold Coast, QLD for four (4) adults, including an opportunity for the winner to appear as an extra in a non-speaking role (“Extra Position”) during production of the Warner Bros. motion picture “Aquaman” (“Picture”). 14. Prize will be awarded in the form of a $6,000 travel voucher to be used by the winner to organise flights and accommodation for themselves and three (3) companions (aged 18 years or over) in Gold Coast, QLD during the period of the shoot. Warner Bros Feature Productions Pty Ltd (“Warner Bros.”) will advise the winner of the dates of the shoot as soon as they are available, but will be in October, 2017. Subject to the additional conditions below, the winner’s three (3) companions will be permitted to visit the set of the film during the winner’s shoot but will not be filmed as part of the role. All companions must be aged 18 years or over. 15. The Extra Position is subject to the following conditions: (a) As a condition of appearing as an extra in the Picture, winner will be required to sign an agreement pursuant to which winner grants Warner Bros., its parent, affiliates, subsidiaries, licensees and assigns an irrevocable right to use winner’s name, voice and likeness in the Picture and in Picture advertising and marketing materials; (b) The Extra Position is a non-speaking role; (c) In addition to the travel voucher, Warner Bros. will pay winner a day rate for services rendered as an extra; (d) Warner Bros. cannot make any guarantee that winner will appear in the final version of the Picture; (e) Depending on winner’s union and/or guild status, winner may be required to execute applicable union or guild documents; (f) Winner and his/her companions may be required to execute a confidentiality agreement in connection with the set visit; 3 (g) In no event shall any entrant seek or be entitled to rescission, injunctive or other equitable relief or to enjoin or restrain the production, distribution, advertising, exploitation and/or marketing of the Picture; and (h) Warner Bros., and its parent, affiliates and subsidiaries, are not responsible for the promotion, administration or execution of the promotion. 16. Any ancillary costs associated with redeeming the travel voucher are not included. Any unused balance of the travel voucher will not be awarded as cash. Redemption of the travel voucher is subject to any terms and conditions of the issuer including those specified on the travel voucher. 17. Total prize pool value is $6,000. 18. Each entrant warrants that their entry is an original literary work of the entrant that does not infringe the rights of any third party. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. 19.
