TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and
Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2. The Promoter is Trustee for Yogurtland Administration Unit Trust trading as Yogurtland Administration PTY LTD (ABN 504 092 87 860) of 50 Hunter Street, Newcastle NSW 2300; telephone 1300 709 709 (“Promoter”).
3. Individuals can enter the promotion via entry form In-store and/or Online. Prizes from in store and on line entries will differ and Individuals can enter both by following entry requirements stated in this T&Cs.
- To enter via any Yogurtland Australia store individuals need to buy any product at any Yogurtland Australia store to receive the entry form. There is no additional cost to enter the promotion.
- To enter via online form, entry is free of charge and Individuals must have a Facebook account to access entry fields.
Promotion is only open to ACT Australian residents, NSW Australian residents, VIC Australian residents, QLD Australian residents and WA Australian Residents, with no age restrictions.
4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or first cousin.
5. Promotion starts on 01/09/2016 and ends at 11pm AEST on 30/09/2016
(“Promotional Period”). The promotion consists of 2 formats with different prizes for each one:
6. Entry Details:
- In-Store Entry: Entrants will receive an entry form when buying any product at any Yogurtland Australia store during the promotional period. The entry form consists of Name and Email address. Entrants will have to fill out the entry form and place form into the entry box available at the respective Yogurtland Australia Store.
To enter, individuals must include their contact details on the entry form available at any Yogurtland Australia Store according to the following steps during the Promotional Period:
(a) Visit any Yogurtland Australia Store (All locations available on http://www.yogurtlandaustralia.com.au/findus-aus.php);
(b) Buy any Yogurtland product
(c) Receive the entry form and include personal details in the appropriate fields
(d) Place the entry form into the entry box available at the store
- Online Entry: Entrants can visit www.facebook.com/yogurtlandaustralia to participate. Entry is free of charge. Entrants will be requested to include their name, email address and their closest Yogurtland Australia location. All winners will be required to pick up their correspondent prize at the Yogurtland location selected by them on the entry form.
To enter, individuals must include their contact details on the promotional form that will be shared on the promoters Facebook page according to the following steps during the Promotional Period:
(a) Visit the Yogurtland Australia Facebook Page at
www.facebook.com/yogurtlandaustralia (“Facebook Page”);
(b) Click on promotional tab “BENELAND”
(c) Include personal details on the appropriate fields.
(d) Click on “enter now” to complete entry
The same entry form URL might be also shared and available in other Facebook pages, not exclusive to the promoters’ Facebook page.
Each entry must be submitted separately and in accordance with entry requirements.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8. Incomplete or indecipherable entries will be deemed invalid.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10. Entries will open and close according to the instructions available at this Terms and Conditions.
Entries will be collected from 8am on 01/09/2016 until 11pm on 02/10/2016.
Entries in each format (in-store or online) will NOT be entered into any subsequent Contest.

The Promoter will use a computer drawing system to randomly select the winners of the In-store and Online prizes, generating a certificate of validity for each prize. All draws will be conducted at the Promoters Head Office (50 Hunter Street, Newcastle NSW 2300) on 25/10/2016, at 2pm.
12. All in-store & online Winners will be contacted via email on 01/11/2016. Winners will be also published on www.facebook.com/yogurtlandaustralia on 04/11/2016.
13. The Promoter’s decision is final and no correspondence will be entered into.
14. If for any reason a winner does not take a prize (or an element of a prize) by 3 months after the winner’s announcement, the prize will be given away to customers in store on a first in best dressed basis.
15. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. Total prize pool will be AU$26,042 (Twenty Six Thousand and forty two Dollars)
17. Prizes, or any unused portion of a prize, are not transferable, refundable or exchangeable and cannot be taken as cash.
18. Prize Distribution:
- In-store Winners: Prizes will need to be collected by the winners from the store where the participant entered the competition. The total number of secondary prizes will be equally distributed between all Yogurtland Australia Stores and the random draw will be conducted following the below points:
o All entries, separated by store location, will be collected by the Yogurtland Australia Head Office Marketing Team.
o Entries will be added to the random drawing system separated by store
o The Yogurtland Australia marketing team will then conduct the random draw by giving the same amount of prizes per store location entry group.
o A few stores will get 1 extra secondary prize each as the division of prizes do not equal an entire number per store as per below distribution.

- Online Winner: Winners will have to pick up their prizes at the physical store indicated by them on their entry form.
19. Entrants consent to the Promoter using their name, likeness and/or image in the event they are a winner (including photograph and/or film of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. Each winner agrees to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.
20. Entrants in the competition permit the Promoter to contact them by email with any correspondence regarding the competition, new flavours and promotions, discounts and any other promotional content from Yogurtland Australia. Entrants can unsubscribe from Yogurtland’s data base at anytime by clicking the “unsubscribe” button sent out on all emails.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
22. Any cost associated with accessing the Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.
23. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
24. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
