CONTEST COMMENCEMENT AND CLOSING TIME
2. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this photo contest is deemed acceptance of these Terms and Conditions.
3. The “Sharks To Crocs Adventure Photo Contest” (the “Contest”) begins on 17 September 2014 at 00.00AM AEST and ends on 31 October 2014 at 11.59PM AEST (the “Contest Period”).
ELIGIBILITY
4. The Contest is open to all persons aged 18 or over at the time of entry. Individuals must have an Instagram, Facebook or Twitter account to be able to enter.
5. Employees (and their immediate family members) of YHA Australia and YHA Ltd and agencies associated with this Contest are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
6. To be eligible to enter the Contest, individuals must take an original and creative photograph that characterises the ‘adventure face’ theme. Examples of this theme will be available on the Backpacking Mate Facebook Page, YHA Twitter Account and YHA Instagram account (as defined below).
ENTRY METHODS
7. To enter the Contest, individuals must complete one of the following entry methods during the Contest Period:
Facebook Entry
a) Login to your Facebook account;
b) Visit the Backpacking Mate Facebook page at www.facebook.com/backpackingmate (“Backpacking Mate Facebook Page”);
c) Become a fan of the Backpacking Mate Facebook Page by clicking the ‘like’ button, if not an existing fan;
d) Upload a photo of your best ‘adventure face’ with the #YHAAdventureFace hashtag as instructed in the ‘Sharks To Crocs Adventure’ tab. Only entries with the #YHAAdventureFace hashtag will be eligible.
OR
Twitter Entry
a) Login to your Twitter account;
b) Become a ‘follower’ of @YHA_Australia (“YHA Australia Twitter Account”), if not an existing follower;
c) Upload a photo of your best ‘adventure face’ with the #YHAAdventureFace hashtag and mention @YHA_Australia in the caption field. Only entries that contain both the #YHAAdventureFace hashtag and mention @YHA_Australia will be eligible.
d) Entrants must ensure that their Twitter account is set to public (not private) in order to be eligible to participate.
OR
Twitter Entry
a) Login to your Instagram account;
b) Become a ‘follower’ of @yhaaustralia (“YHA Australia Instagram Account”), if not an existing follower;
c) Upload a photo of your best ‘adventure face’ with the #YHAAdventureFace hashtag and mention @yhaaustralia in the caption field. Only entries that contain both the #YHAAdventureFace hashtag and mention @yhaaustralia will be eligible.
d) Entrants must ensure that their Instagram account is set to public (not private) in order to be eligible to participate.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) each entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
DECISION
10. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the originality and creative merit of the photo submitted, and how well the photo characterises the ‘adventure face’ theme.
11. The winner will be selected at YHA Ltd Head Office at 3/9 Castlereagh Street, Sydney 2000 NSW. The winner will be contacted by email, his/her name will be announced on the Backpacking Mate Facebook Page, YHA Australia Twitter Account and YHA Australia Instagram Account no later than 07 November 2014.
12. If the winner cannot be contacted within 3 months of the announcement, a new winner will be selected by the Promoter.
13. The Promoter’s decision is final and no correspondence will be entered into.
PRIZE
14. The best valid entry, as determined by the Promoter, will win a ‘Sharks to Crocs Adventure’ (“the Prize”), consists of the following components:
i) 2 x 10-night YHA accommodation packs
ii) 2 x one-way economy flights to Adelaide from the winner’s closest capital city in Australia
iii) 2 x return economy flights from Adelaide to Port Lincoln
iv) 2 x Shark Cage Dives with Calypso Star Charters
v) 2 x one-way train journey on The Ghan from Adelaide to Darwin
vi) 2 x Crocsaurus Cove activity
vii) 2 x one-way economy flights from Darwin to the winner’s closest capital city in Australia
15. The Prize, or any unused portion of the Prize, are not transferable or exchangeable and cannot be taken as cash.
16. The Prize must be redeemed as a whole (all components outlined in 14) no later than 30 June 2015; components cannot be redeemed separately.
17. The Prize is subject to the terms and conditions of the entities supplying the Prize or components of the Prize.
18. All flights, accommodation, train and tours must be booked at least one month in advance to the winner’s intended travel dates and the dates must be flexible as they are all subject to availability.
19. Once booked, no changes can be made to the bookings. If the winner can no longer travel for any reason after the Prize is booked, the Promoter does not take responsibility for the winner losing parts or all of the components of the Prize as a result, no substitute will be offered.
20. It is highly recommended that the winner purchases travel insurance as it is not included in the Prize.
21. As a condition of accepting the Prize, the winner may be required to sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form
GENERAL
22. As a condition of entering this Contest, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entries for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
23. The Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Contest.
24. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Contest (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Contest, as appropriate.
26. This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook or Twitter. Entrants understand that they are providing their information to the Promoter and not to Instagram, Facebook or Twitter. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Contest must be directed to the Promoter and not to Instagram, Facebook or Twitter. Instagram, Facebook or Twitter will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the Contest (including taking/use of the Prize), except for any liability which cannot be excluded by law.
