HOW TO ENTER
1. To enter, individuals must during the Promotional Period complete the competition entry form by following the links here. As part of their entry individuals have the opportunity to invite 3 friends to enter but will not receive a bonus entry for doing so. Entrants must ensure that they have the prior consent of any individual to whom they wish to send the competition link.
2. Entries open at 10.00am AEDT on 8th November 2017 and close at 10am AEDT on 6th December 2017 (‘Promotional Period’).
TERMS AND CONDITIONS
1. Information on how to enter and the prizes form part of these Terms and Conditions. By entering, entrants acknowledge that they have read and understood these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged 18 years or over, as of the date of entry, who submit their entry into this promotion in accordance with these Terms and Conditions.
3. Employees, managers and directors of the Promoter and agencies associated with this promotion, and their immediate families, are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. The Promoter reserves the right, at any time, to verify the validity of entries and the eligibility of entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
5. Multiple entries are NOT permitted, the use of scripting or any other form of automation is prohibited and will result in any entries submitted on that basis being invalidated.
6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
7. Entrants can only submit an entry via the Riders By Lee Australia website.
8. The promotion commences at 10.00am AEDT on 8th November 2016 and closes at 10am AEDT on 6th December 2016.
9. One winner will be drawn at 12pm AEDT on 7th December 2016 at the Promoter’s Premises, True Alliance 28 – 34 Rooney Street, Richmond, VIC 3121, Australia.
10. The Promoter will contact the winner via the provided email address within two business day of the draw. The winner’s name will also be published online at ridersbylee.com.au from 7th December 2016 for 28 days.
11. The Promoter’s decision on all aspects of this promotion is final, but subject to state and territory legislation, and no correspondence will be entered into.
12. Total Prize Value $4,000 AUD (including GST) as at 19/10/16.
13. One winner and their three guests will receive an awesome Airstream experience perched on the rooftop of a nondescript Melbourne carpark, otherwise known as Notel, including:
• One night’s accommodation on a Tuesday, Wednesday or Thursday night between January and May 2017 for 2x Airstreams trailers at Notel. Each 31 foot Airstream trailer features their own outdoor deck, WiFi, iPad Pro loaded with Netflix, room for two with a Queen Size bed, ensuite bathroom and fully stocked mini bar worth $800 AUD (subject to availability & not valid over special event periods).
• $1,200 AUD worth of Riders product of your selection (subject to availability)
• A voucher for flights with Virgin Australia up to the value of $2,000 AUD.
14. If for any reason a winner does not redeem their prize by the time stipulated by the Promoter, then the prize will be forfeited.
15. The winner is required to confirm their accommodation date by 3 January, 2017. Dates must be acceptable to the Promoter and prize supplier.
16. The prize must be taken within the date provided. All ancillary and additional travel costs are the winner’s responsibility.
17. Prizes, or any unused portion of the prizes, are not transferable or exchangeable and cannot be taken as cash.
18. If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. If the prize is unclaimed, a second chance draw will be held at 10.00am (AEST) on 4 January 2017, to distribute the prize prior to the accommodation eligibility dates. The second chance winner must provide confirmation of dates by 18 January 2017. The winner of any second chance draw will be contacted by email within 2 days of the draw and published online at ridersbylee.com.au from 1 February 2017 for 28 days.
20. In relation to the comment which an entrant uses to enter the promotion (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, requirement to attribute or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights. Entrants agree that they are fully responsible for the Content they use to enter the promotion. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for all loss and damage whatsoever which is suffered (including but not limited to indirect or consequential loss) by the Promoter as a direct or indirect result of any breach of the above terms or the entrant acting inconsistently with or breaching any part of these Terms and Conditions.
21. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
22. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or any entries in its absolute discretion; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. For example, the Promoter may disqualify: (a) any entries that tamper with, or attempt to tamper with the entry process; (b) any entries that contain material that is obscene, indecent, objectionable, defamatory, libelous or otherwise contravenes an applicable law or infringes any third party's rights; (c) any entries that the Promoter considers inappropriate for any reason; (d) any individuals found entering who corrupt or affect, or attempt to corrupt or affect, the administration, security, fairness or proper conduct of the entry process. The Promoter's decision in relation to disqualification is final and no correspondence will be entered into.
24. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
25. Entrants acknowledge that the Internet is not a secure medium and that the Promoter is not responsible for the security of entries.
26. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
27. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including for negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
28. By submitting an entry into this competition entrants consent to receive promotional and other marketing messages from the Promoter and Notel Melbourne (including messages sent electronically for an unlimited period of time). Entrants will be able to opt-out at any time by following the instructions included in each message sent by the Promoter. The Promoter and its related entities collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy on request by writing to the Promoter using the details below.
29. The Promoter and Notel Melbourne collects personal information and keeps it on a database in order to conduct, administer and publicise the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and its marketing and promotional agencies, information technology providers, database providers and overseas related bodies corporate. Entry is conditional on winners providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct any information held by the Promoter to the Promoter at the address below.
30. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the various social media providers’ user terms and conditions.
31. This promotion is in no way sponsored, endorsed or administered by, or associated with, any social media provider. Entrants understand that they are providing their information to the Promoter and not to any social media provider. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to any social media provider. Social media providers will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
