Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. The Promoter may require entrants and their companion to provide proof of age in a form acceptable to the Promoter. Should an entrant or their companion be unable to satisfy this requirement, the entrant will be ineligible for the prize. Entrants and their companion must be able to attend the St Kilda Festival on Sunday 11 February, 2018. Entrants residing outside Victoria must be able to travel to Melbourne from their nearest capital city on Saturday 10 February, 2018 and depart Melbourne on Monday 12 February, 2018. Dates and schedules of the prize are subject to change. The Promoter takes no responsibility for any date or schedule changes. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. Promotion Period The promotion begins at 12pm AEDT on Monday 22 January 2018. Entries for the promotion will close at 5pm on Friday 2 February 2018. Entry Method During the Promotion Period entrants must visit www.stkildafestival.com.au and complete the online entry form including providing their full name, mobile phone number, email address, date of birth, state and answer the question “Which Australian act would you like to see at the 2019 St Kilda Festival and why?” This is a game of skill; chance plays no part in determining the winner. Each valid entry received during the Promotion Period will be individually judged by representatives of the Promoter (Judges) in accordance with the judging details below. The Judges will select one (1) entry, subject to the Judging Criteria, from all valid entries received within the Promotional Period and award that entrant with the prize. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Entries are deemed to be received at the time of receipt by the Promoter not at the time of transmission by the entrant. Maximum Number of Entries Maximum one (1) entry per person during the Promotional Period. Judging All valid entries will be individually judged by representatives of the Promoter on Monday 5 February 2018 at the Promoter’s premises to determine the one (1) Prize winner. All valid entries will be judged based on the Judging Criteria. The winner will be notified in accordance with the Notification of Winners information. The Promoters decision is final and no correspondence will be entered into. Judging Criteria Each valid entry will be individually judged (by representatives of the Promoter) based on enthusiasm and creativity. Prize Details There is one (1) prize to be won: • Return economy flights for two (2) people to Melbourne Tullamarine Airport flying Tigerair from the winners nearest capital city that Tigerair operate from, traveling on Saturday 10 February 2018 and returning on Monday 12 February 2018 inclusive of airfare related taxes and charges. (Note: If winner is from Victoria a $200 Tigerair flight voucher will be provided to the winner). • 15kg check-in luggage allowance per person, for the winner and their companion (excluding Victorian winner). • Two (2) nights twin share accommodation at Rydges St Kilda to be shared by the winner and their companion (Check-in Saturday 10 February 2018, check- out Monday 12 February 2018) • Breakfast for two (2) people on one (1) day at Rydges St Kilda • Access for two (2) people to the St Kilda Festival VIP Main Stage Lounge on Sunday 11 February 2018 for the duration of one (1) act to be determined by the Promoter. Prize valued up to AU$1,600 (including GST) In the event that for any reason a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. Travel conditions • All components of the prize are to be arranged by a representative of the Promoter and/or an agent nominated by the Promoter at its sole discretion. • Redeeming the prize and any tickets, passes or vouchers issued as part of the prize is conditional on acceptance of terms and conditions as detailed by the Promoter, any prize providers and the airline carrier in accordance with normal travel practices. • All travel must be completed on Saturday 10 and Monday 12 February 2018 and is subject to availability and conditions of all prize suppliers. If winner is from Victoria they will receive a $200 Tigerair voucher to be used within 12 months of date of issue. • Spending money, meals, additional activities and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the Prize Details above are the responsibility of the winner and his/her nominated companion as incurred. • The winner is responsible for all mini bar and additional room charges at Rydges St Kilda. The winner will be required to hand over a credit card upon check-in to act as security bond for the room. The winner is responsible for any damage made to Rydges St Kilda during their stay. • The winner is responsible for any amendments fees issued by Tigerair or other prize suppliers as a result of an action of the winner and/or their companion, once booking is confirmed and ticketed. • The Promoter takes no responsibility for loss or injury suffered by a winner and/or their companion as a result of taking the prize. • It is recommended that the winner and their nominated companion have valid travel insurance for their period of travel. • No portion of the prize is redeemable for cash. The prize is not refundable or transferable. • The Promoter and prize providers accept no responsibility for any changes and/or cancellations to the events or activities. In the event that one or more event or activity is no longer available, the remainder of the prize shall constitute the complete and total prize. The Promoter will not enter into any further correspondence with the winner and his/her nominated companion. • If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation. • All components of the prize must be taken together and when offered or are forfeited. Any element of the prize not taken will be deemed to be forfeited. • The prize winner and their companion must travel together and participate in the prize together at all times. • If the winner and their companion miss any of the arranged flights, the winner will forfeit the prize (at the Promoter’s absolute and sole discretion). • The winner and their companion must not be under the influence of any drugs and may consume alcohol in moderation but must not be under the influence of alcohol during any activities to the extent that it impairs or affects their understanding, judgment or participation in the activities, and subject to any limitations of the Promoter, any prize supplier and prevailing laws and regulations. • The prize winner and their companion must be in good health and must not have any pre-existing medical conditions that would prohibit them from entering this promotion or participating in any way in the prize. • The Promoter, its agents and its prize partners may use the winning entry and the winner and their companions name, likeness, images and/or voices (including photograph, film or recording of the same) from (but not limited to) their participation in the Prize, in any media for an unlimited period without further notification, compensation or remuneration for the purpose of promoting, publicizing or marketing this promotion (including the Prize and any outcome) and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and/or its partnering clients. Prize Claim Date and Time The prize must be claimed by 5.00pm AEDT on Tuesday 6 February 2018. If the prize is not claimed by the Prize Claim Date and Time, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to award the prize to the next best valid entry which meets the Judging Criteria, determined by the judges.
