CONDITIONS OF ENTRY
By entering this Promotion, Entrants agree to abide by these Conditions of Entry. The Promoter is ACCO Australia Pty Ltd, ABN: 16 000 265 047, 2 Coronation Ave, Kings Park NSW 2148 and Ph: 02 9695 2500.
The Promotion commences at 15:00pm AEDT on 17 November 2016 and closes at 15.00pm AEDT on 21 December 2016 (Promotion Period).
Entry is open to any Australian resident aged 13 years or older (Entrant). Entrants under 18 years old must have parental/guardian approval to enter and the parent/guardian of the entrant must read and consent to these conditions. Parents/guardians may be required by the Promote to enter into a further agreement as evidence of consent to this Promotion. An Entrant’s entry into the Promotion will be deemed to be a representation that the Entrant is 18 years of age or older or between the ages of 13 and 18 and entering this Promotion with the permission of a parent or legal guardian who agrees to be bounds by these conditions of entry. If you are a parent of legal guardian agreeing to these rules for the benefit of a child between the ages of 13 and 18, you are fully responsible for his or her Entry in the promotion, including without limitation any legal liability that he or she may incur. Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
To enter the Promotion, Entrants must visit The Original Texta Facebook page at https://www.facebook.com/TheOriginalTexta/, then accurately complete an online entry form on The Original Texta Facebook page, referring a friend via email and submit it so that it is received during the Promotion Period (Entry). Before referring a friend, the entrant must first ensure they have the consent of the friend prior to nominating them to receive the details of the promotion.
Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
On the Thank You Page of the entry form Entrants have the option to refer a friend to obtain an extra entry into the draw. Entrants can receive up to a maximum of 6 entries – one for sharing the competition on Facebook and up to five by referring five friends via email. Entrants will need to enter the names and email addresses of up to 5 friends via email to obtain the additional entries. Before referring friends, the entrant must first ensure they have the consent of the friend/s prior to nominating them to receive the details of the promotion. Extra entries will only be valid for referrals made via the entry form. The Promoter will not use the information received in the record of referral for any ongoing marketing communications. The Promoter will only use this information the one time in conjunction with the contest. Referred records will not be entered into the Promoter’s database.
By accepting the terms and conditions upon entering the promotion you are automatically entered into the Promoter’s email database.
No purchase is necessary to enter. Purchasing products will not help your chances of winning.

The Prize Draw will be conducted at 15:30pm (AEDT) on 21 December 2016 at 3/145 William St, Darlinghurst NSW 2010. The Major Prize Winner will be the first valid Entry drawn. The Runner Up Prize Winners will be the subsequent two (2) valid entries drawn. Prizes are not transferable or exchangeable, and cannot be taken as cash.
Each Winner will be notified by telephone within five (5) business days of the Prize Draw, will receive written confirmation within twenty-one days and their name will be published on The Original Texta Facebook page at https://www.facebook.com/TheOriginalTexta/ on 22 December 2016. In their written confirmation, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 31 March 2017 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by telephone within two days of the Unclaimed Prize Draw, receive written confirmation within twenty-one days and their names will be published on The Original Texta Facebook page at https://www.facebook.com/TheOriginalTexta/ on 4 April 2017.

Supplying your valid contact details are part of the conditions of entry to this promotion. All contact details entered incorrectly shall be deemed invalid.
The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and/or New Zealand (“Non-Excludable Guarantees”). If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Promotion.
This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to ACCO Australia Pty Ltd and not to Facebook.
In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the ACCO Australia Pty Ltd database. The Promoter and ACCO Australia Pty Ltd may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the ACCO Australia Pty Ltd Privacy Policy. i. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
ii. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
iii. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
