Win the ultimate trip to Las Vegas! - Schedule to Terms of Entry FordMustang Facebook Competition PromotionWebsite: https://www.facebook.com/FordAustralia/xxx Promoter: Ford Motor Company of Australia Limited, Campbell field, VIC, 3061 EntryRestrictions: Entrants must be: ·      18 years of age or over; ·      a citizen of Australia; ·      in possession of a valid Australian driver’s licence; ·      in possession of a valid passport; and ·      eligible to obtain entry into the United States of America (USA). Competition Summary: From 6:00pm AESDT Tuesday 18th March 2014 to11:59pm AEST on Friday 4th April 2014, eligible members of the public will be invited to submit an entry (consisting of a photograph or avideo) to the Promotion Website which describes: in celebration of the 50th anniversary of Mustang: What is Australia’s ‘Route 66’ and where would you drive the new Mustang? At the end of the Competition Period, entries will be judged by the Promoter.  The Promoter may, in its sole discretion: ·      choose a Winner to receive the GrandPrize (as described below); or ·       choose two (2) Finalists who will appear on national television on or about 13 April 2014 at which time one (1) winner will be chosen to receive the Grand Prize.   Conditions ofEntry: By submitting an entry, in the form of a video or a photo, the entrant grants the Promoter a non-exclusive worldwide, royalty-free license to use, copy, display publically, any materials, including without limitation video and photo material, submitted in connection with the entry.Each entrant hereby represents that they own all rights to materials, including without limitation video and photo material, submitted in connection with their entry. Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms. 1.1. In respect of their entry each entrant warrants and represents that: 1.1.2. the entrant is the sole owner and author; 1.1.3.the entrant has the right to make the description and photo/video available to thePromoter, as contemplated by these rules; 1.1.4.the video or photo does not contain personally identifiable information about the entrant or any other person(s) without their consent with the exception of their name; 1.1.5.the text and photo does not contain any infringing, threatening, false,misleading, abusive, harassing, libellous, defamatory, vulgar, obscene, nude,scandalous, inflammatory, blasphemic, pornographic, profane, or otherwise objectionable or illegal content; and 1.1.6the video or photo do not infringe upon the copyright, trademark, contract rights, or any other intellectual property rights of any third person or entity, or violate any person’s rights of privacy or publicity, and the text and photo do not prominently include trademarks owned by third parties; copyrighted materials owned by third parties; names, likenesses, voices or other characteristics identifying celebrities or other public figures, living or dead. Competition Period The Competition Period is from 6:00pm on Tuesday18th March 2014 to 11:59pm AEST on Tuesday 4th April 2014. Entry Method: During the Competition Period: 2.1. Visit Facebook.com/FordAustralia/xxx. 2.2. All entrants are required to: 2.2.1. complete all of the required fields on the application form; 2.2.2. “like” the Ford Australia Facebook page 2.2.3.upload a photo or video of their answer to in celebration of the 50th anniversary of Mustang,  what isAustralia’s ‘Route 66’ and where would you drive the new Mustang? 2.3. Entry into the competition is free and no purchase is necessary to enter or be selected as a Finalist or the Winner.   Maximum Number of Entries: Entrants may submit up to four entries however each entry must be submitted via a separate online entry form and contain a substantially different photo or video. Judging Criteria: At the end of the Competition Period, each valid entry will be individually judged (by representatives of the Promoter) based on, among other things, the entrant’s creativity, originality and how interesting and unexpected their entry is.  Entries will be uploaded on the promotional Facebook app and members of the public will be able to ‘like’ each entry submitted. Judges will also consider how many likes each entry receives.  The number of likes by each entry will not be the only factor in determining the Finalist(s) or Winner (and therefore, the entries that receive the highest number of public likes or the most public interaction will not necessarily be selected). Selection Process: The Promoter may, in its sole discretion: ·      choose a Winner to receive the GrandPrize (as described below); or ·      choose two (2) Finalists who will appear on national television on or about 13 April 2014 at which time theWinner will be chosen by a panel to receive the Grand Prize. If a Winner is selected by the Promoter, the Winner will be contacted by phone or email within 24 hours of the submissions closing.  The Winner and his/her companion must be available to travel to Las Vegas on 13 April and stay for six (6) nights. The Winner must provide any documentation and assistance reasonably requested by the Promoter in order for the Promoter to facilitate the Grand Prize (eg. To make necessary travel arrangements). If the selected Winner cannot be contacted within 24 hours of selection, does not provide reasonable documentation and assistance, is notable to travel on the specified dates, or otherwise does not meet all of these rules, an alternate Winner may be selected and notified. Under no circumstances may a Winner transfer their participation to another person. Where the Promoter chooses two Finalists, the Finalist(s) will be contacted by phone or email within 24 hours of the submissions closing.   TheFinalists and their companions must be able to fly to Sydney for one night (if required) on 12 April 2014 at the Promoter’s expense and be willing and able to appear on national television in Sydney on 13 April 2014.  One (1) of the two Finalists will be selected as the Winner by a team of judges on the show using the Judging Criteria detailed above. Following notification of selection as a Finalist, the Finalist(s)must immediately provide any documents and assistance reasonably requested by the Promoter in order for the Promoter to facilitate the Grand Prize (in the event that the Finalist is successful). If a selected Finalist cannot be contacted within 24hours of selection, does not provide reasonable documentation and assistance,is not able to travel on the specified dates, or otherwise does not meet all of these rules, an alternate Finalist may be selected and notified or any Finalist who has met all rules may be deemed to be the Winner. Under no circumstances may a Finalist transfer their participation to another person. At the time of the television appearance on 13 April 2014, bothFinalists and their companions must be in a position whereby they are able to take the Grand Prize (eg.  are available and able to travel to Las Vegas on 13 April 2014 for six (6) nights). When taking part in this selection process,spending money, meals, additional activities and any other ancillary costs,including but not limited to insurance and any applicable insurance excesses are the responsibility of each Finalist and their companion (where applicable),as incurred. Grand Prize Details: The Grand Prize is valued at twenty-five thousand dollars ($25,000). The prize values are based on recommended prices as at the commencement of the competition. The Grand Prize consists of: return airfares for economy tickets for two (2) to Las Vegas from the Winner’s closest capital city (except where two (2) Finalists are chosen to appear on national television in which case the return airfares will be fromSydney), all transfers, visas/entry paperwork, six (6) nights of accommodation in a hotel in Las Vegas, attendance at the Ford Anniversary celebrations on 17April (location to be determined), Grand Canyon Sunset Helicopter tour withDinner, and two thousand ($2,000) spending money. Further Terms and Conditions: The Winner will be required to appear in and share photographs and video content detailing their experience of the GrandPrize. The Winner and his/her companion must travel together. The prize suppliers, including without limitation, the accommodation and airline providers, are at the discretion of the Promoter. The Finalist(s)/ Winner are not able to upgrade their airline tickets or accommodation. The Grand Prize does not cover any costs incurred other than what is specified in the Grand Prize Details. The Winner and his/her companion, are responsible for all other costs including, without limitation, meals (other than as specified in the Grand PrizeDetails), room service, passports, telephone charges, laundry and tips.   The Promoter is not responsible for any cancellation, postponement,delay or rescheduling of transport and any costs incurred as a result,including without limitation, any accommodation costs which will be the responsibility of the Finalist(s)/Winner. The Promoter takes no responsibility for loss or injury suffered by theWinner of Finalist(s), or his/her companion as a result of taking a prize except as required by law. The Promoter recommends that the Winner andFinalist(s) (and their companions, where applicable) have valid insurance to participate in the prize.   TradePromotion: Game of Skill Terms ofEntry 1 These Terms of Entry (“terms”) must be read together with theSchedule for this competition. The Schedule defines certain terminology used in these terms as well as setting out other important information. By entering,entrants accept these terms and the terms of the Schedule. To the extent of any inconsistency between the Schedule and these terms, the Schedule prevails. 2 Entrants must meet the Entry Restrictions set out in the Schedule. It is the responsibility of each entrant to check withUS government travel advisory and immigration authorities regarding eligibility for entry into the USA.  Each entrant indemnifies the Promoter for any fines, penalties, payments and expenditure incurred as a result of not meeting the Entry Restrictions. 3. Employees, officers, directors, dealers and agents of thePromoter and affiliated companies and WPP Group, Wunderman Pty. Ltd., PLC and affiliated and subsidiary companies, representatives, legal advisors, any other advertising, promotion, and fulfillment agencies and the immediate family or members of their same households (whether related or not) of such individuals are not eligible to apply or participate in the competition. 4 To enter the competition, entrants must follow the Entry Method during the Competition Period. 5 Entrants may submit up to the Maximum Number of Entries.Multiple entries (where permitted) must be submitted separately. 6 The Promoter accepts no responsibility for late, lost,incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration,tampering, deletion, theft, destruction, transmission interruption,communications failure or otherwise. The Promoter has no control over communications networks or services, the Internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Any form of automated entry using any device or software is invalid. 7 This is a game of skill; chance plays no part in determining theFinalist(s) or Winner. Each valid entry will be individually judged based on the judging criteria as set out in the Schedule. 8 The judges' decisions are final and no correspondence will be entered into. 9All entries and materials submitted to the Promoter in connection with this competition (in any form, including without limitation in hard copy or electronic form and including but not limited to material produced as part of the Mustang competition), become the property of the Promoter and each entrant warrants that he/she has the right to transfer these things to the Promoter.Each entry must be the entrant’s original work. By entering this competition entrants: (a) consent to the Promoter making copies of or publishing the whole or any part of their entry and otherwise exploiting the entry and any rights in relation to the entry to publicise this competition or for any other purposes; and (b)undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights. 10 Entries that, in thePromoter’s judgment, contain offensive, defamatory or otherwise objection able or inappropriate material or that otherwise infringe these terms or any third party rights will be invalid. 11 The prizes are specified in the Grand Prize Details. 12The Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel a prize or otherwise cease to provide any benefit of a prize if the entrant, in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of thePromoter or any of its related bodies corporate (or of the business of thePromoter or any of its related bodies corporate), is contrary to law or is otherwise inappropriate. 13 If an entry is deemed not to comply with these terms, the Promoter reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the competition. 14 The Finalist(s) and/or Winner will be notified and selected as stated in the Selection Process section of theSchedule. 15 Entrants acknowledge that there may be inherent risks in some aspects of the competition and the prizes offered, including without limitation the prize experience, and that participation in the competition and/or taking a prize may involve participating in dangerous activities. By entering this competition and/or accepting the prize, entrants accept that risk. 16 In order to participate in this competition and/or take any prize, entrants must comply with applicable  height, weight, health, fitness, skill, balance, dexterity and any other requirements normally associated with any related activities. It is the entrant’s responsibility to ensure that they are sufficiently healthy and fit so as to safely participate in this competition and/or undertake the activities awarded as part of a prize. The Promoter reserves the right to deem that an entrant is not sufficiently healthy or fit to participate in this competition and/or take any prize. The entrant must comply with all requirements and directions of the people responsible for the conduct of the relevant activity. 17If requested by the Promoter, any entrant, Winner, Finalist (and their companion, where applicable) must sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking any specified activities forming part of the competition or prize. If any entrant or companion does not sign the indemnity form provided by the Promoter within the time requested by the Promoter, the relevant entrant’s entry or claim will be deemed invalid. 18 Prizes and participation in this competition are subject to any conditions imposed by the supplier or organiser of the prize, as applicable. 19 The Promoter and its associated agencies and companies will not be liable for any loss (including,without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or taking part in any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 20 The Promoter may require theFinalist(s) and Winner to provide identification as requested by the Promoter including (without limitation) proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at thePromoter’s discretion. 21 The Promoter reserves the right, at any time,to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms. Errors and omissions will be accepted at the Promoter's discretion. If due to any reason whatsoever the Promoter becomes aware after an entrant has won a prize that the entrant has not complied with these terms, that entrant will have no entitlement to the prize, even if the Promoter has announced them as a Finalist or Winner and that entrant will be required, at the direction of the Promoter,to return, refund or otherwise make restitution of the prize. 22 The Promoter may, in its sole discretion, disqualify any or all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these terms, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. 23 No prize is transferable or exchangeable, nor can it be redeemed for cash (unless otherwise indicated). 24 In the event for any reason the Winner does not take an element of any prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the Winner and cash will not be supplied for that element of the prize. 25 The Promoter accepts no responsibility for any variation in prize value. 26 Where a prize or part of a prize is unavailable for any reason, the Promoter may substitute for that prize or part of a prize with another item of equal or higher value as determined by the Promoter. Without limiting the foregoing, the Promoter may,in its absolute discretion, substitute cash for any prize in an amount that thePromoter reasonably determines is of equal value to that part of the prize. 27 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-ExcludableGuarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury;or any loss or damage (including loss of opportunity); whether direct,indirect, special or consequential, arising in any way out of the competition. 28 If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries. 29 Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 30 Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this competition or of these terms. 31 The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings.Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. 32 Each entrant must ensure that any other person whose details have been provided by the entrant to thePromoter for the purposes of the entrant’s participation in this competition has given their implied or express consent for their details to be provided to the Promoter and any of its related bodies corporate and to be contacted by thePromoter or any of its related bodies corporate in relation to this competition. 33 The Promoter collects personal information("PI") in order to conduct the promotion and may, for this purpose,disclose such PI to third parties, including but not limited to agents,contractors, service providers and prize suppliers. Entry is conditional on providing this PI. If an entrant selected "Yes" to receive future news from thePromoter or if otherwise permitted by law, the Promoter may also contact him/her with marketing materials that may be of interest.  These communications might include thePromoter contacting you (including via electronic messaging) about special offers, promotions and Ford vehicles, products and services. The Promoter may also disclose the entrant’s personal information to its dealers, its related companies and third parties who provide the Promoter with (or help the Promoter provide) products and services, including to overseas locations such as theUSA, India, China and Singapore.  ThePromoter’s privacy policy, which can be viewed at www.ford.com.au/privacy, states how individuals can access or correct any personal information the Promoter holds about him/her, how to complain about a privacy breach by the Promoter and how the Promoter will deal with a privacy complaint. Entrants can contact the Promoter at 13 FORD (13 3673), at customers@fordcrc.com.au or via the ContactUs page at www.ford.com.au. 34 Unless the contrary intention appears, a reference in these terms or the Schedule or in any advertisement relating to this competition to Australian dollars, dollars, AUD$or $ is a reference to the lawful currency of Australia. 35 Entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this competition. Entrants acknowledge that this competition is in no way sponsored, endorsed or administered by, or associated with,Facebook.  Entrants acknowledge that any information provided by entrants is provided to the Promoter and not to Facebook.
