MINISTRY OF SOUND ‘ULTIMATE WELLNESS WEEKEND’
PROMOTION TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is Ministry of Sound Australia (ABN 16 106 918 601) of 200 Crown Street, Darlinghurst, NSW, 2010.
3. Entry is only open to Australian residents aged 16 years or over. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible.
4. Promotion commences at 5:00pm AEDT on 01/12/16 and closes at 11:59pm AEDT on 18/12/16.
5. Individuals can enter the promotion through the UpViral application, promoted via Ministry of Sound Australia’s Facebook Page, located at www.facebook.com/MinistryofSoundAU and Ministry of Sound Australia’s website, located at www.ministryofsound.com.au.
6. To submit a valid entry, entrants are required to provide their personal contact information, including Name, Email Address, Date of Birth, Postcode and state, and an Answer to the competition questions. Any entrants who fail to provide true and correct information within their entries will be deemed invalid, and excluded from the competition. Entrants may enter the promotion as many times as they wish.
7. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. Entrants understand that they are providing their information to the Promoter and not Facebook. The information they provide will only be used for the purposes as set out in these Terms and Conditions. Any questions, comments or complaints should be directed to the Promoter and not Facebook. Individuals acknowledge and agree that its use and interaction with the Facebook website are entirely of their own volition and accord and Ministry of Sound Australia bears no liability nor responsibility in respect of such interactions.
8. This is a game of skill and chance plays no part in determining the winners.
9. There will be 1 winner of the competition. The Winner will be determined at the sole discretion of Ministry of Sound Australia. The competition is valued at RRP $3,000 and is not redeemable for cash. The winner of the competition will be awarded the following: 2 nights twin/double Deluxe Orchard Suit accommodation at Gwinganna Lifestyle Retreat, organic meals and snacks, a 50 minute classic massage per person, access to all facilities and scheduled activities, transfers from Gold Coast airport, a $500 flight voucher. Conditions apply to booking – subject to availability. May not be combined with any other voucher or offer. Bookings should be made at least 45 days in advance. Valid for 6 months from date of prize draw, some block out dates apply. Prize is not transferable and has no cash value. Only available to residents of Australia who are aged 18 years and older.
In respect of the Prize, MoS takes no responsibility in respect of the fitness, suitability, quality, availability nor any other aspect of the Prize. Accordingly, by entering this competition, you agree that MoS will have no liability to you (and you indemnify MoS in respect of any third party claim) in respect of any failure, delay or other aspect of such aspects that may or may not impact upon your enjoyment of the Prize.
You hereby fully indemnify and hold MoS harmless in respect of any claim, action, expense, fee or other liability that may arise in connection with your use, mis-use and/or non-use of the following:
a. the Prize;
b. all of your travel in respect of the Prize;
c. all ancillary aspects and services related to the Prize;
, together the “Prize Benefits”; and
d. your activities and behaviour conducted in, around or during your enjoyment or other use of the Prize Benefits.
10. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including as a result of tampering, hacking or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant or voter, or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
11. Any costs incurred throughout the production or submission of entries is the sole responsibility of the entrant.
12. The laws of New South Wales, Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
13. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter shall hold an entrants personal information in a secure manner, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Entrant. The entrant may opt out of receiving such services by emailing the Promoter at: info@ministryofsound.com.au or following the directions provided in any material sent by the Promoter to the entrant. Entrants should direct any request to access, update or correct information to the Promoter at info@ministryofsound.com.au. All entries become the sole property of the Promoter. If entrants, at any time, require their personal information to be deleted from the Promoter’s database, the entrant must email the Promoter at: info@ministryofsound.com.au. The entrant acknowledges that such deletion from the database renders their entry into the game void.
