Enxo Cash Draw – Terms and Conditions – Competition 4
TERMS AND CONDITIONS
Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed to be acceptance of these Terms and Conditions.
The promoter is Enxo Pty Ltd (ABN 74 600 483 494) of Level 4, 973 Nepean Highway, Bentleigh, VIC 3204. Telephone: 1300 989 477 (“Promoter”).
The competition will commence on 13:01 AEDT Friday 17 November 2017 and run until 12:00 AEDT Wednesday 22 November 2017.
The winner will be drawn on Wednesday 22 November 2017 at 13:00 AEDT at Level 4, 973 Nepean Highway, Bentleigh, Victoria, 3204.
Subject to clauses 6 and 7, competition entry is open to all residents of Australia over the age of 18 years who are members of Enxo.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. All of those mentioned above are eligible to participate in the Enxo Benefits Program as members, but are ineligible to win prizes in this or any other Enxo competition.
Final entries to the competition must be received no later than the specified Competition Period (“Competition Period”). The Competition Period is specified in clause 3.
All Enxo members are automatically entered into the draw. Members that do not wish to participate in this or any other draw must notify Enxo.
Members that join Enxo after the promotion period are not eligible for this weekly cash draw.
Enxo will award the winner with the prize value in line with their Enxo membership status up tier, up to a total value of $1,000AUD. The details are as follows:
Blue Members – prize value is equal to $100 AUD
Bronze Members – prize value is equal to $200 AUD
Silver Members – prize value is equal to $300 AUD
Gold Members – prize value is equal to $600 AUD
Platinum Members – prize value is equal to $1000 AUD
Enxo will send a cheque to the winner’s postal address via registered post (Australia Post). More detail about how to increase your status as a member can be found on the Enxo website.
The Promoter reserves the right, at any time, to verify the validity of entries and members (including an member’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, submitted an entry that is not in accordance with these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation arising out of any such an offence are reserved.
The number of entries into the draw during the competition period are determined by the member’s status tier. These details are as follows:
Blue Members – one (1) ticket in the prize draw
Bronze Members – three (3) tickets in the prize draw
Silver Members – ten (10) tickets in the prize draw
Gold Members – fifteen (15) tickets in the prize draw
Platinum Members – twenty (20) tickets in the prize draw
Incomplete or indecipherable member sign-up entries will be deemed invalid.
If there is a dispute as to the identity of a member or entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter’s decision is final and no correspondence will be entered into.
Any ancillary costs associated with redeeming the Prize are not included. Redemption of the Prize is subject to any terms and conditions of the Promoter.
The winner will be notified via email and/or phone within two (2) business days of the draw Date and their name will be published on enxo.com.au and Enxo social media by 24 November 2017. Members agree to be identified (initial, surname and suburb) on Enxo’s website and social media. If they do not, they must advise Enxo.
Subject to the unclaimed prize draw clause (as outlined below in clause 20), if for any reason the winner does not claim / take / redeem the Prize (or an element of the Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
Entrants acknowledge that the prize only includes the dollar value that a member is eligible win depending on their status tier (see clause 11 for more detail). The Promoter is not liable in any way for any other expenses pertaining to claiming, receiving or using the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any circumstance beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the membership joining portal is the entrant’s responsibility and is dependent on the Internet service provider used.
Five reserve winners will be drawn in conjunction with each of the two prize draws. If Enxo is unable to contact the original winner within 90 days, then the reserve winner 1 will be granted the prize. The unclaimed prize draw winner will be notified via email and/or phone within two (2) business days of the 90 day expiration date of the first draw and their name will be published on enxo.com.au and Enxo social media within 5 business days of being contacted. Members agree to be identified (initial, surname and suburb) on Enxo’s website and social media. If they do not, they must advise Enxo. Enxo will continue to attempt to contact each reserve winner over a 90 day period, until they have reached Reserve Winner 5. If a winner cannot be contacted after all reserve winners have been exhausted, then the competition will be void.
Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties or similar consumer protection laws in the States of Australia (“Non-Excludable Guarantees”).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: the promotion, including but not limited to (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) redemption of, use of, taking of and/or participating in the Prize.
The Promoter collects personal information ("PI") for the purpose of conducting this promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed on the Enxo website. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
