TERMS AND CONDITIONS
PARTICIPATION
Information on how to enter the "Werther's Original – Dream Holiday" (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions. Promotion is not valid in conjunction with any other competition, special, discount or promotional offer unless indicated otherwise.
Entry is only open to Australian residents aged 18 years or over ('Entrants'). Employees (and their immediate families) of Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1 Smail Street, Ultimo, NSW 2007, Australia (Promoter), Participating Retailers (as defined below) and agencies associated with this promotion are ineligible to enter.
The Promotion commences at 12:01am (AEST) on 9 July 2018 and entries close at 11:59pm (AEST) on 30 September 2018 (Promotional Period). All times are based on Sydney local time.
ENTRY
To enter the Promotion, Entrants must, during the Promotional Period undertake the following steps:
purchase one (1) pack of Participating Product (as defined below) from any Participating Retailer (as defined below) nationally (Qualifying Purchase); and
submit a valid entry form in accordance with these Terms and Conditions.
Participating product (Participating Product) means any of the following Werther's Original products: Cream Candies 50g Roll; Cream Candies 3 x 50g Multipack; Chewy Toffee 45g Stick; Cream Candies No Sugar Added 42g Box; Cream Candies 140g Bag; Cream Candies No Sugar Added 60g Bag; Chewy Toffees 135g Bag; Eclairs 100g Bag, Creamy Filling 125g Bag and Golden Mix 380g Box.
For the purposes of this Promotion, a participating retailer (Participating Retailer) is any of the following stores/shops: Independent Grocery, Australia Post, Impulse, Newslink and WH Smith in Australia, that stocks Participating Products and displays promotional advertising material for this Promotion during the Promotional Period. Participating Retailers EXCLUDES all Coles, Woolworths/Safeway and Aldi branded supermarkets and convenience stores (e.g. Coles Express and Woolworths Petrol). For clarity, if an individual purchases any Participating Product from a retailer that is not displaying the promotional advertising material during the Promotional Period then that product will not be eligible for entry into the Promotion under the Qualifying Purchase requirement.
To enter, individuals must during the Promotional Period submit a valid entry form by:
visiting www.werthersdreamholiday.com (Promotional Website); and
inputting the requested details, including their full name, date of birth, contact telephone number, a valid email address and the last six (6) digits of the product barcode found on the back of the Participating Product; and
submitting the fully completed online entry form including the answer to the following question in 25 words or less: Tell us where your dream holiday would be and why? (Promotion Question).
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Purchase; (b) each entry must be substantially unique in respect of the Entrant's answer to the Promotion Question, submitted separately and in accordance with the entry requirements; (c) only one (1) product barcode per entry is permitted; (d) unrecognised barcodes will be deemed invalid; and (e) maximum of one (1) entry per Entrant per day is permitted.
Entrants must retain the original purchase receipt(s) for each Qualifying Purchase used to enter the Promotion. The original purchase receipt(s) must clearly show where and when each Participating Product was purchased. Entrant's Failure to produce the original purchase receipt for each entry when requested may, in the absolute discretion of the Promoter, result in invalidation of that entry for which no receipt is produced and forfeiture of any right to a prize in respect of that entry.
All entries must be received by the Promoter during the Promotional Period. Entries received before the start of the Promotional Period or after the close of the Promotional Period will be deemed invalid and will not be eligible to win any prize. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
Entrants can only enter in their own name and not on behalf of another individual. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant's identity, age and place of residence and proof of purchase i.e. a copy of the receipt) and reserves the right, in its sole discretion, to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
PRIZES AND WINNER SELECTION
There will be one (1) prize awarded each week of the Promotional Period (Weekly Prize) and one (1) major prize awarded at the end of the Promotional Period (Major Prize). Entries received between 12:01 am AEST on Monday and 11:59pm AEST on Sunday, during each week of the Promotional Period, will be entered into the judging period for that week's Weekly Prize. Each Weekly Prize winner will be notified by a representative of the Promoter by the following Friday by either email and/or phone. Each Weekly Prize winner will also be entered into judging for the Major Prize.
The best valid entry, during the relevant weekly period, as determined by the Promoter will win the Weekly Prize. Each Weekly Prize will consist of AUD$250 cash, to be transferred via EFT into each winner's nominated bank account. If a winner does not have a bank account, the AUD$250 cash will be awarded in the form of a cheque in the winner's name as it appears on the winning entry form.
The Promoter will not, to the fullest extent permitted by law, take any responsibility for any Weekly Prize being lost and/or transferred to an inaccurate/incorrectly provided bank account or cheque sent to an inaccurate/incorrectly provided address.
The best of the Weekly Prize winning entries, as determined by the Promoter, will win the Major Prize of an AUD$20,000 travel voucher from Free-2-Travel Holidays Pty Ltd (Free-2-Travel). The Major Prize Winner will be notified by a representative of the Promoter by Thursday 11th October 2018 by either email and/or phone. The terms and conditions for acceptance of the Major Prize are as follows:
The Promoter recommends that the Major Prize winner and their companion obtain travel insurance.
To the extent permitted by law, the Promoter is not responsible for and cannot be held liable for any element of a prize which is cancelled or delayed, or where the location is changed, or any other occurrence, which is out of the reasonable control of the Promoter.
Any travel prize is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner. Travel voucher is valid until 31 October 2019. The travel voucher must be redeemed through Free-2-Travel and their suppliers, no direct bookings are permitted, if direct booking is made a 10% service fee will be charged at winner's own expense. Vouchers are not redeemable for cash or cash products i.e., Travelex, foreign currency etc. All bookings and documentation regarding the prize must be made via Free-2-Travel or their agents. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Free-2-Travel and the airline carriers in accordance with normal travel practices. No portion of the prize is redeemable for cash. The prize is not refundable or transferable. The winner and companion must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure for international destinations. Winner is responsible for any amendments fees issued by airlines or suppliers once booking is confirmed and ticketed. Visas, valid passports, additional spending money, meals (other than those included) and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed in the travel prize package descriptions above are the responsibility of the travel prize winner and his/her nominated traveling companions as incurred. It is the winner's responsibility to organise transport to/from the airport departure/return point.
GENERAL
This is a game of skill and chance plays no part in determining the winner. All valid entries will be judged based on literary and creative merit. The Promoter reserves the right to select reserve entries and record the reserve entries in order of merit in the event that the original entry (or any subsequent reserve entry) is deemed ineligible, or the winner (or any subsequent reserve) does not claim their prize in the required time in accordance with the instructions provided by the Promoter (Unclaimed Prize Winners).
The original winner of the prize must claim the prize prior to 11:59pm (AEDST) on 31 October 2018 by following the instructions referred to by the Promoter. If the prize remains unclaimed prize then the Unclaimed Prize Winner must claim the prize within two weeks of being notified by the Promoter, and in accordance with the instructions provided by the Promoter.
The total prize pool for this Promotion is up to AUD$23,000.
The Promoter's decision in all matters relating to this Promotion is final and no correspondence will be entered into.
Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If a Prize (or an element of a Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that element of the Prize) with another prize of equal value and/or specification.
If for any reason a winner does not use, redeem or take a Prize (or an element of a Prize) by or at the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited and will not be redeemable for cash.
Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
Any cost associated with entering the Promotion, or accessing the Promotional Website is the Entrant's responsibility and is dependent on the Internet service provider used by the Entrant.
Any documentation associated with a prize, including tickets and vouchers, are void if stolen, forged, mutilated or tampered with in any way.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) the Promotion; (b) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in Prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or Entrant; or (g) use, redemption or taking of a prize.
As a condition of accepting a prize, each prize winner (and their companion), must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy (see http://www.stuartalexander.com.au/privacy-policy). In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose personal information overseas. All entries become the property of the Promoter and all Entrants consent to any use of their entry which may otherwise infringe the content creator's/creators' moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights.
The laws in force in New South Wales apply to this Promotion to the exclusion of any other law. Entrants submit to the jurisdiction of the courts of New South Wales.
