I. TERMS OF USE
By accessing, browsing and/or using this website you agree to the terms of use and agree to use the site in accordance with all applicable laws. If you do not agree to the stated terms you must cease to use this website. We may periodically change the terms, so please check them from time to time as your continued use of the site signifies your acceptance of any changes carried out.
Cold Rock Management Pty Ltd ACN 078 334 326 (CRM) takes privacy very seriously and no information will be given out to any third party.
COLD ROCK ONLINE CAKE ORDERING SYSTEM
CRM operates a Cold Rock Online Cake Ordering System (“Online Order”) on behalf of individual Cold Rock stores (“CRStore”).
Customers may use the Online Order to place orders for bespoke Cold Rock Cakes (“Cake”) with a CRStore.
The CRStore with whom the order has been placed should, within 24 hours of the order being placed, make direct contact with the individual ordering the Cake. If no contact is received within this time, the individual should contact the CRStore directly.
All Cakes are hand-made, therefore the CRStore requires a minimum 72 hours’ notice for Cake preparation.
The CRStore will endeavour to have the Cake prepared by the nominated collection date and the requested time. Neither CRM nor the CRStore will be liable for late delivery.
All Cakes ordered on the Online Order must be collected from the selected CRStore at the nominated time.
Should a customer wish to cancel their order prior to collection, they must contact CRM Head Office directly, who will issue a refund back to the credit card of purchase.
Refunds will only be permitted up to 72 hours prior to the collection date and time. No refunds will be given for Cakes that are cancelled with less than 72 hours notice of their collection date and time, or after the nominated date and time.
Cakes may only be returned to the CRStore if:
i. the Cake collected is not the Cake ordered; and
ii. the Cake has not been consumed; and
iii. proof of purchase (receipt) is provided.
Returns will be given in the form or a credit note or cash at the CR Store’s sole discretion.
Any compensation will be limited to the cost of the Cake only.
Although every care is taken, CRM will not be held liable for any lost, missing, incomplete, late or erroneous Cake orders received as part of the Online Order.
COLD ROCK VIP CLUB
All the required fields need to be filled in for the registration form to be processed.
If you are under 10 years old and use the same e-mail address as someone else, please send an email with your details to info@coldrock.com.au and you will be manually subscribed.
The Cold Rock VIP Club entitles the member to:
i. Receive a Buy One Get One Free for Subscribing Voucher (BOGOFS), entitling the recipient to receive a free Cold Rock Ice Cream.
ii. Free Birthday Ice Cream Voucher (FBI) on their birthday.
iii. Birthday Cake Voucher (BCV), allowing a discount of $10 off their birthday cake.
By joining the Cold Rock VIP Club you agree to receive ongoing Cold Rock promotional material.
VIP BUY ONE GET ONE FREE (BOGOF) SUBSCRIPTION VOUCHER
Entrants to the VIP Club will receive a BOGOF voucher, which entitles the recipient, on presentation of the voucher, to receive a free regular sized Cold Rock Ice Cream when purchasing any other regular sized Cold Rock Ice Cream at the relevant store’s normal selling price. This excludes all Mix Ins.
The redemption offer is available at all Cold Rock stores.
To redeem the BOGOF voucher, it’s store preference that the emailed voucher is printed and presented in store, if this is not possible and all alternatives have been exhausted, customers may display the voucher on their mobile device.
Only one transaction per email voucher may be used.
Stores may request identification to confirm that the presenter is the correct person listed on the email voucher.
VIP FREE BIRTHDAY ICE CREAM VOUCHER (FBI)
The FBI entitles the birthday person to get 1 kiddies size (4oz) Cold Rock Ice Cream with 1 Mix In for free.
To receive a FBI, the customer’s details must be registered with CRM at least 8 days prior to their birthday.
The FBI will be provided by email, at least 7 days before the birth-date and will be valid on the actual birthday date only.
To redeem the FBI voucher, it’s store preference that the emailed voucher is printed and presented in store, if this is not possible and all print alternatives have been exhausted, customers may display the voucher on their mobile device.
Stores may request Identification to confirm that the presenter is the correct person and that their birthday is on the day of redemption.
If a Cold Rock store is closed due to a public holiday, the FBI may be used the day before or the day after the public holiday.
VIP BIRTHDAY CAKE VOUCHER (BCV)
The BCV entitles the birthday person to get $10 off the purchase of any Cold Rock Cake, provided the purchase of the Cold Rock Cake is $30 or above.
All BCV can only be redeemed by ordering a Cold Rock Cake via the Cold Rock Online Cake Order System (“Online Order”) at www.coldrock.com.au.
To receive a BCV, the customer’s details must be registered with CRM at least 35 days prior to their birthday.
The BCV will be provided in the form of a unique email, at least 28 days before the birth-date and will be valid for use up to 7 days after the actual birthday only.
Customers will need to enter the unique code (single use only) provided in the mail into the Online Order, when prompted, at time of the Cake order.
Not available at Cold Rock Express stores.
COLD ROCK LOYALTY CLUB CARDS (LCC)
The LCC will be stamped once, for every ice cream or ice cream based beverage purchase.
There is a limit of one (1) stamp per ice cream, no matter the value (E.G. a kiddies ice cream and a large ice cream are both entitled to one stamp each, as are Take Home Packs and Cake purchases).
There are no limits per transaction (E.G. If a customer purchases 5 ice creams in one transaction, they are entitled to 5 stamps).
LCC are for the individuals use only and are not transferable (ie cannot be shared).
Only one LCC discount can be redeemed per transaction.
FOR ALL COLD ROCK VOUCHERS
No Loyalty Card stamp will be issued.
Original Vouchers only.
Cannot be used in conjunction with any other Cold Rock voucher.
Only one Voucher per transaction.
May not be reproduced or copied by any means what-so-ever.
Cold Rock Franchisees and their staff have the right to refuse the use of the voucher if there is any evidence of tampering or duplication.
Voucher-holders have the right to request CRM to assess any decision made by Cold Rock Franchisees, by writing to info@coldrock.com.au.
COLD ROCK $5 GIFT VOUCHERS
Cold Rock $5 Gift Vouchers (“CR$5”) have a value of AU$5.
CR$5 are to be treated like cash.
Lost or stolen CR$5 will not be replaced or refunded.
CR$5 are valid at all Cold Rock stores within Australia.
No change will be given.
CR$5 are not redeemable for cash.
CR$5 are not valid unless they are stamped with an approved store stamp and the purchase date entered.
CR$5 are valid for 12 months from purchase date.
CR$5 may not be reproduced or copied by any means what-so-ever.
Cold Rock Franchisees and their staff have the right to refuse the CR$5 if there is any evidence of tampering or duplication.
Recipients of CR$5 have the right to request CRM to assess any decision made by Cold Rock Franchisees, by writing to info@coldrock.com.au
COLD ROCK $2 MOUNT FRANKLIN OFFER
One (1) 600ml Mount Franklin Water may be purchased for $2.00 with every transaction.
Limit of one (1) 600ml Mount Franklin Water per transaction.
Mount Franklin Water is 600ml size only.
A transaction is a full price purchase of any product or products sold at the Cold Rock store, where the offer is being redeemed, excluding packaged drinks.
Not valid in conjunction with any other offer or promotion or free product.

2016/17 ENTERTAINMENT BOOK VOUCHERS

“ROCKY’S AUSSIE ROAD TRIP” PROMOTION
The Rocky’s Aussie Road Trip Promotion (“RARTP”) commences at 12:00pm AEDT on 19 January, 2017 and concludes at 11:59pm AEDT on 16 February, 2017 (“Promotion Period”), with a new image being published each Monday and Thursday.
The Promotion is open to all Australian residents.
All employees, or immediate relatives of Cold Rock Pty Ltd (CRM) are ineligable to enter the Promotion.
To enter the RARTP, entrants must, during the Promotion Period:
i. Visit the Official Cold Rock Facebook page www.facebook.com/OfficialColdRock or Instagram page www.instagram.com/coldrockofficial to view the latest promotional image;
ii. Guess the location of the promotional image as prompted;
iii. Proceed to visit www.coldrocksummer.com;
iv. Enter their personal details as required; and

v. Answer the following question: “In 20 words or less, tell us where in Australia is Rocky on his Road Trip?

Entrants may enter the RARTP as many times as they like throughout the Promotion Period.
CRM accepts no responsibility for any technical difficulties and / or associated web costs in relation to the RARTP process.
During the Promotion Period, eight (8) entrants will be selected as the winners (“the Winners”), based on having the correct and most creative answer.
The decision in regards to the Winners will be made by CRM and is final and no correspondence will be entered into.
The Winners will each receive a prize of $200 worth of Cold Rock Gift Vouchers, provided by CRM.
The total value of prizes is $1,600; and is subject to the following conditions;
i. Each prize of $200 will be provided in the form of Cold Rock 40 x $5 Cold Rock Gift Vouchers (“CR$5);
ii. Lost of stolen CR$5 will not be replaced or refunded;
iii. CR$5 are valid at all Cold Rock stores within Australia;

ix. Cold Rock Franchisees and their staff have the right to refuse the CR$5 if there is any evidence of tampering or duplication.
All Winners will be notified by e-mail and / or phone and advertised on the “Official Cold Rock Ice Cream” Facebook and Instagram Pages from 23 January, 2017.
Winners have a two (2) week period to claim the prize from when they are contacted. Should they not be contactable within this time, CRM may select a new winner.
FRANCHISEE DEPOSIT REFUND POLICY
The deposit invoice represents the deposit for a proposed Cold Rock franchised store.
The deposit invoice would only be issued to a proposed Cold Rock Franchisee who has received the draft generic disclosure document.
The deposit is fully refundable less any Internal Administrative Costs as defined in the proposed Franchise Agreement, which is contained in the draft generic disclosure document provided.
Any dispute must follow clause 33 of the proposed Franchise Agreement, which is contained in the draft generic disclosure document provided.
