The following Terms and Conditions apply to Toro Australia’s Saturday Morning Mowers’ Club Competition 2022 (“Competition”). Where there is any inconsistency between these Terms and Conditions and any other material relating to the Competition, these Terms and Conditions will prevail. Participation in the Competition constitutes acceptance of these Terms and Conditions. Only entries that are submitted and comply with these Terms and Conditions may be eligible to win this Competition. The promoter is Toro Australia (ACN 47 001 310 443) of 53 Howards Road, Beverley SA 5009. Competition Dates Commences: Monday 18 April 2022 Concludes: Sunday 12 June 2022 at 11.59 pm (AEST) Prize draw: Tuesday 14 June 2022 at 2.30 pm (AEST) Prize Winner notified by: Wednesday 15 June 2022 Prizes Toro are giving away the following prize packs: ? First prize: Two (2) 22? (56cm) Personal Pace mower (RRP$1,099) and two (2) Merch packs (RRP$42 each) ? Second prize: Four (4) 60V MAX* Battery Leaf Blower Bare Tool (RRP$169), four (4) 60V* 2A Charger (RRP$79), four (4) 60V* 2.5 Ah 135Wh Battery (RRP$199), and four (4) Merch packs (RRP$42 each) ? Third prize: Four (4) Merch packs (RRP$42 each) The prizes are not transferable or exchangeable and cannot be redeemed for any other form of compensation (including cash). How to Enter To enter, each Entrant must, during the Competition period, access the Competition Entry Page and submit the following: Version 1 | 18 April 2022 1 ? For Toro owners: Send a picture or video of their lawn with a Toro mower in it and tell us in 25 words or less how their Toro mower has helped make their lawn the talk of the town. ? For non-Toro owners: Tell us in 25 words or less how a Toro mower would help make their lawn the talk of the town. Incomplete entries, and entries received after the close of the Competition, will be ineligible. Entries can only be made in an individual’s own name, and no entry can be made for, or on behalf of, any other person. Only one (1) entry is allowed per person. Who May Enter Entry is open to all Australian residents currently residing in Australia, 18 years of age or over, excluding: A. Directors, management and employees or contractors of Toro Australia, and its related companies and agencies; B. The spouse, de facto spouse, parent, natural or adopted child, or sibling of such directors, management, employees and contractors (whether or not they live in the same household); C. Directors, management and employees of any authorised Toro dealers or third parties involved with the Competition. Prize Draw This Competition is a game of skill. All Prize(s) will be awarded to the winning entrants based on the subjective decision of Judge(s)’s assessment of the creativity and originality of your entry. With five (5) winners being selected from the Toro owners section and five (5) from the non Toro owners section. The winners will be decided on Tuesday 14 June 2022 at 2.00 pm (ACST) at the Promoter’s marketing agency’s office at Unit 3/116 Melbourne Street, North Adelaide SA 5006. No correspondence will be entered into in respect to the draw. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). Winner Notification The Prize Winners will be notified via the phone number supplied at the time of entry, by close of business on Wednesday 15 June 2022. If any of the Winners cannot be contacted within 3 months of each Prize Draw (i.e. attempts to contact the Winner have been met with failure), the Winner will no longer be entitled to the Prize and the Promoter will undertake a redraw at 2.00pm (ACST) at the Promoter’s marketing agency’s office, Unit 3/116 Melbourne Street, North Adelaide SA 5006 on 15 September 2022. The Replacement Winner is then the Winner of the prize for the purpose of these Terms and Conditions. Version 1 | 18 April 2022 2 The Winner must provide their address to receive their Prize. Toro Australia will contact the winner in regards to organising suitable pickup or delivery of the Prize. The Prize will be delivered within six weeks following successful contact with the Winner. Publicity & Promotion The name of the Winners will be published by The Promoter on Toro Australia’s Facebook page within two business days of the Prize selection. Toro Australia may request an image of the Winner with their Prize to be used for promotional purposes. The Promoter reserves the right to use your supplied email to inform you about the Competition, and for future marketing initiatives. You are able to unsubscribe from email marketing at any time by following the instructions contained in any marketing email. Toro Australia uses cookies on the Competition entry and thank you pages to personalise future marketing initiatives. Other Conditions of Entry Entry into the competition is free but any cost associated with entering the Competition (including accessing the website) is the entrant’s responsibility. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter which prevents the Promoter from complying with these Terms and Conditions (including awarding any part of the prizes), the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Competition at any time. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any theft, unauthorised access or third party interference; (b) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in prize value to that stated in these Terms and Conditions; or (d) use of a prize/taking of a prize.
