Type of Promotion: This promotion is
a promotional game conducted pursuant to the Charitable and Non-Profit Gaming Act 1999 (QLD);
a trade promotion lottery conducted pursuant to the Gambling Regulation Act 2003 and Gambling Regulations 2015(VIC);
a trade promotion lottery conducted pursuant to the Lottery and Gaming Regulations 2008(SA);
a trade lottery conducted pursuant to the Gaming Control Act and Gaming Control (Community Gaming) Regulations (NT);
a trade promotion lottery conducted pursuant to the Lotteries and Art Union Act 1901 (NSW);
a trade promotion lottery conducted pursuant to the Lotteries Act 1964 (ACT);
a trade promotion for the purposes of the Gaming Control Act 1993(TAS)
Promoter: The Promoter is Surf Life Saving Foundation (ACN 159 849 591), of 190 Montpelier Rd, Bowen Hills QLD 4006, telephone 1800 642 925 (collectively, the Promoter). The Promoter and its related companies are referred to as the Promoter Group.
Promotion Period: Entry to the promotion is open from 12:00am (AEST) on 27 June 2017 until 11:59:59pm (AEST) Monday 14 August 2017.
Eligibility: Entry to the promotion is free.
The competition is open to residents of Australia who are 18 years of age or older.
The following people are not eligible to win any prizes from either prize draw:
directors, managers, agents and employees of the Promoter Group and their immediate families;
directors, managers or employees of agencies associated with the promotion; or
How to enter: To enter, entrants must:
Visit the competition website at http://www.surfgames.com.au, and register their details on the registration screen, (Registration);
Play the Swipe Dreams game (Game) by choosing whether the player likes the image that is displayed. Use a swipe on a mobile device to make a choice (swipe left for no, and right for yes). Use the buttons on a desktop browser. Players will gain a draw entry for every 10 images they view up to a maximum of 10 entries.
Players must answer any questions served during the game to receive draw entries.
Prize: Prize consists of one draw of $2,000 AUD (Australian Dollars).
Total promotion prize pool: up to $2,000 AUD.
Conduct of the draw: The winning entries will be drawn randomly by computer at 1/55-61 Holdsworth Street, Coorparoo, QLD 4151 no later than 11:00am (AEST) Friday 4 August 2017.
The first valid entry drawn will win the prize subject to:
producing to the Promoter if requested identification acceptable to the Promoter which confirms that the entrant is over 18 years of age; and
The Promoter's decision as to the result of the draw is final and no correspondence will be entered into.
Notification to prize winners: The Promoter will attempt to notify the prize winners by email or telephone within 14 business days of the draw and the initials and postcode of the prize winners will be displayed the Promoter's website on http://www.surflottery.com.au by Monday 7 August 2017.
Delivery of Prizes: The prizes will be sent to the prize winner’s nominated address by registered post.
No right to transfer prize: The right to a prize is not transferable or assignable to another person.
Unclaimed Prize Draw: If a prize winner:
is unable to be contacted; or
is able to be contacted but fails to satisfy the verification requirements set out in clause 8;
within 3 months after the date of the applicable draw, then that person’s right to the prize is forfeited and the prize will be entered into an unclaimed prize draw.
The Promoter may conduct such further draws at the same place as the original draw as are necessary on Friday 18 August 2017 at a time no later than 11:00am AEST in order to distribute any unclaimed prizes, as determined by the Promoter in its absolute discretion, subject to any directions given by a responsible authority under any relevant regulation. The winner will be announced on the Promoters website http://www.surflottery.com.au by Monday 21 August 2017.
Validity of entries: The Promoter reserves the right, at any time, to verify the validity of an entry or disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. The decision to verify, validate or disqualify an entry is in the Promoter's absolute discretion.
Computer system issues: No responsibility is accepted for late, lost or misdirected entries. The Promoter is not responsible for any problems or technical malfunction of any computer system, software or Internet difficulties, including any damage to an entrant's computer, resulting from participation in the promotion. Any cost associated with accessing or submitting an entry is the entrant's responsibility.
Liability: The Promoter will not be liable for any loss or damage or personal injury suffered or sustained in relation to the promotion or a prize except for any liability which cannot be excluded by law.
Force Majeure: If the Promoter is prevented from or delayed in performing an obligation by Force Majeure then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances. "Force Majeure" means an event beyond the reasonable control of the Promoter, which occurs without the fault or negligence of the Promoter.
Delay or modification to conduct of the promotion: Subject to obtaining the approval from the regulator (if applicable), the Promoter reserves the right to delay or modify any aspect of this promotion if for any reason it is not capable of running as planned (including without limitation, by reason of infection by computer virus, bugs, tampering, fraud, technical failures, power failures or due to any other causes unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion) but only to the extent necessary to overcome the issue that is affecting the running of the promotion as planned.
Changes to terms and conditions: If the Promoter reasonably considers that a change to these terms and conditions is likely to:
benefit entrants; or
be of no or immaterial detriment to entrants,
then subject to obtaining approval from the regulator (if applicable), the Promoter can make the change and may place a notification on the Promoter’s website http://www.surflottery.com.au.
Privacy:
The Promoter Group is authorised to collect certain personal information for the purpose of entry into the Promotion under the legislation set out in clause 2 (including regulations and/or rules made under that legislation).
By participating in the promotion, an entrant authorises the Promoter Group, and contractors and agents of the Promoter Group, to access, collect and use the personal information collected about the entrant and disclose personal information about the entrant to the Promoter Group and its contractors and agents (which may include disclosure to financial institutions, lawyers, auditors, IT service providers, mail service providers, marketing service providers, market research companies, selling agents) and gaming and other regulators, for the purposes of:
conducting the promotion;
conducting market research;
providing the entrant with information about products and services of the Promoter Group. Such information may be provided electronically, or by contacting the entrant by telephone or other means, until such time as the entrant asks the Promoter not to provide further information;
publishing the initial, suburb or town of a prize winner on the Promoter’s Facebook page; and
disclosing the initial, suburb or town of a prize winner to selected media outlets as well as the Promoter’s website. A prize winner may be asked by the Promoter to participate in publicity associated with the promotion. The prize winner will have the right to elect whether or not to participate in that publicity.
Failure to provide personal information: If an entrant does not provide the personal information requested, the entrant cannot participate in the promotion and will not receive information about products and services of the Promoter Group. The Promoter’s Privacy Policy, available at http://www.surflottery.com.au/privacy/, contains further information about how you may access and seek a correction of your personal information, how you may complain about privacy related matters and information about how your complaint will be dealt with. All references to time in these terms and conditions are a reference to Australian Eastern Standard Time (AEST).
