TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is open to residents from Australia, aged 18 years and over only. The travel companion of the winner must also be 18 years or older. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or indecipherable entries will be deemed invalid.
The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.
Entrants may only enter once.
Promotion commences on 7 September 2019 and closes on 30 September 2019 (“Promotional Period”).
There is 1 prize in total. Includes one night stay in Darwin at the DoubleTree by Hilton Hotel Esplanade Darwin in a guest room including breakfast on the night of 27th March 2020, transfer for 2 people from the hotel to the Darwin cruise terminal on the 28th March 2020, 10 night cruise aboard Sea Princess from Darwin to Sydney departing on the 28th March 2020 till 7th April 2020. Total prize value is $4638.
The Prize does not include:
Connecting transfers to the winner’s nearest capital city listed in the Prize details
Incidentals including telephone charges
Food and beverage not included in tour
Excess baggage charges
Fees resulting from booking changes or cancellations
Any other costs not specified in the Prize details including spending money, booking change fees or cancellation fees or any other costs of a personal nature not stated
The winner and guest must travel at the same time, not separately;
The winner and guest must be 18 years of age or over.
Frequent flyer miles and points cannot be accrued on this Prize.
If requested by the Promoter (in its sole discretion), the winner and guest must sign an indemnity and exclusion of liability form in order to claim and participate in the Prize.
Prize is not transferable or exchangeable and cannot be taken as cash.
The final prize draw will take place at 12:00pm ACST 1 October 2019 at Holidays of Australia and the World. All valid entries received within the Promotional Period will be entered into the Prize draw. At the time of the draw, an online application which generates random integers (‘Drawing Application’) will generate one integer from the range of entry numbers. The winning entry will be the entry whose entry number corresponds to the integer generated by the Drawing Application.
If the Drawing Application generates an integer corresponding to an entry number that is deemed ineligible, the Drawing Application will be used to generate additional integers until an eligible winner has been determined.
The winner will be notified by phone and in writing via email, and the winner’s name published on www.holidaysofaustralia.com.au on 1 October 2019. The Promoter’s decision is final and no correspondence will be entered into.
Prize claim date & time: 31 October 2019. If a prize is not claimed by the prize claim date, the winner forfeits the prize and a new winner will be drawn on 1 November 2019. The new winner will be notified by phone and in writing via email, and the new winner’s name published on www.holidaysofaustralia.com.au on 1 November 2019.
Any and all costs associated with collecting the prize including but not limited to taxes, transport, accommodation, meals, beverages, on-board account, travel insurance, passports, visas, excess baggage and items of a personal nature are the sole responsibility of the Participant.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal or greater value and/or specification.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
