Terms & Conditions
- This competition is conducted by The Nature Conservancy Limited (ACN 104 635 654) of 60 Leicester Street, Carlton, Victoria 3053 Australia (TNC Australia).
- Competition entry is open to any Australian citizen or permanent resident of Australia, over the age of 18, who is not a director or employee (or the immediate family member of a director or employee) of TNC Australia or any of its related bodies corporate (known from hereinafter as an “Eligible Entrant”). TNC Australia reserves the right to confirm and verify that entrants are over the age of 18 by requesting proof in writing.
- Eligible Entrants are invited to submit a name for the Scalyfin fish as seen on TNC Australia’s underwater Reef Cam at Pope’s Eye, Port Phillip Bay Victoria, Australia.
- Each suggestion must be submitted electronically via the online submission form (the “Entry Form”). Submission/s will be deemed an “Entry” or “Entries”.
- These terms and conditions, together with the Entry Form, govern the competition and are intended to be a legally binding agreement. Entry into this competition is deemed acceptance of these conditions of entry. For the purposes of Australian law, this naming contest is a ‘‘competition’ based on set criteria.
- The competition commences at 9am AEST on 3 April 2018 and concludes at 9am AEST on 30 April 2018. Late or incomplete Entry or Entries deemed incomprehensible by the Judging Panel (as defined below) will be deemed invalid.
- Each Eligible Entrant can vote a maximum of 3 times per email address. Additional Entries will be removed from judging.
- TNC Australia reserves the right to disqualify any Eligible Entrant for tampering with the entry process or attempting to act in a fraudulent or dishonest manner.
- TNC Australia will not be liable for any direct, indirect, special or consequential loss or damage caused, or suffered by the winner in relation to this competition or the prize.
- Entries submitted via channels other than our online submission form cannot be attributed to the Eligible Entrant properly, and therefore will not be considered eligible for the contest.
- Entries received by TNC Australia will be judged by a “Judging Panel” consisting of Anita Nedosyko and Simon Branigan, Marine Restoration Coordinators at TNC Australia.
- To ensure eligibility for the contest, all Entries must provide the full name and email address of the Eligible Entrant. Entries that do not meet this requirement will not be deemed valid.
- Judging will take place from 30 April to 11 May 2018. The Eligible Entrant whose Entry is selected by the Judging Panel as the winning Entry ( from hereinafter known as the “Winner”) will be announced 16 May 2018 via TNC Australia’s website.
- All decisions of TNC Australia and the Judging Panel are final. TNC Australia and the Judging Panel will not enter into any discussions or correspondence regarding any decision in relation to the Winner. No feedback will be provided on unsuccessful entries.
- By submitting an Entry and taking part in the competition, each Eligible Entrant warrants that (1) the name they have submitted may be announced in any Australian media publication and TNC’s online and printed publications; and (2) the Entry and reason(s) for the name is/are the Eligible Entrant’s original idea and does not infringe the intellectual property rights of any other person or entity.
- Names will be judged on originality, meaningfulness to the entrant and/or Australian public, relevance to the scalyfin’s personality and/or physical characteristics, and may be inspired by Australian culture and ocean life.
- By submitting an Entry and taking part in the competition, the Eligible Entrant thereby grants to TNC Australia a non-exclusive, perpetual, irrevocable, royalty-free license to use, reproduce, publish, adapt and communicate the name anywhere in the world. The Eligible Entrant acknowledges and agrees that TNC Australia is free to use the name and to exercise its rights in relation thereto. The Eligible Entrant agrees to execute any documentation required to give effect to TNC Australia’s rights under this clause, including any required moral rights waivers. TNC Australia will only ever use the name for non-commercial purposes to promote environmental awareness in support of our work and mission, for example, on our website or in fundraising communications.
- The Winner may be notified on a confidential basis by telephone or email prior to a public announcement by TNC. The Winner must keep confidential the fact that their entry has been selected as the winning entry until a public announcement is made by TNC.
- TNC Australia reserves the right to confirm and verify the identity of the Winner, by requesting the person(s) to provide proof of age, proof of identity and proof of residency. Identification considered suitable for verification is at the absolute discretion of TNC Australia.
- The Winner will have their winning entry featured on the TNC website and on social media after the competition.
- The Winner of the Reef Cam Resident Naming Competition will receive a prize pack valued at $558.
- All prize values are in Australian dollars. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however TNC Australia reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason.
- The prizes require travel to the Melbourne area. TNC Australia is not responsible for associated travel costs to and from Melbourne.
- If TNC Australia does not receive an Entry that meets the expected requirements as determined by the Judging Panel, TNC Australia is not obliged to select a Winner.
- TNC Australia accepts no responsibility for lost, late, incomplete, incorrectly submitted or misdirected entries, including Entries not received by TNC Australia or delays in the delivery due to technical disruptions, network congestion or for any other reason.
- If an Eligible Entrant’s contact details change during the period of the competition, it is the Eligible Entrant’s responsibility to notify TNC Australia. A request to access, modify or delete any information provided in an Eligible Entrant’s Entry should be directed to TNC Australia. No changes may be made to your Entry after submission.
- TNC Australia, respects an individual’s right to privacy and that individual’s right to control how information held on their behalf is used. Please see our privacy policy or contact our Privacy Officer on australia@tnc.org or (03) 8346 8602 for full details on how we handle your personal information. Personal information collected by TNC Australia, from you, will be used to keep you up to date with our work by disseminating information via email, mail, SMS or telephone. This may include newsletters, appeals or other information. Please contact us should you wish to alter or delete any of these methods of contact.
- If the competition is not capable of running as planned for any reason outside the control of TNC Australia including (without limitation) vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism; or due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause which corrupts or affects the administration, security, fairness or integrity or proper conduct of the competition, TNC Australia reserves the right in its sole discretion to take any action that may be available including to cancel, terminate, modify or suspend the competition, subject to any written directions given from the various State or Territory Government authorities (where required).
- TNC Australia and its related bodies corporate will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained in connection with this competition or in connection with any prizes won via this competition except for any liability which cannot be excluded by law. Other than statutory and other warranties that cannot be excluded by law, TNC Australia and its related bodies corporate assume no responsibility for any incorrect or inaccurate information, either caused by an entrant or as a result of any of the systems, equipment or programming associated with or utilised in this competition, or for any technical or human error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line, computer line, mobile telephone or satellite network failure, software, server or provider failure, theft or destruction or unauthorised access to or alteration of entries, and reserves the right to take any action that may be available.
