General
1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to Acer Home Office SOS Campaign 2020 (‘AHOS20’), these Terms and Conditions prevail.
Who can enter:
3. Subject to clause 4, entry to AHOS20 is open to all residents of Australia who have fulfilled the requirements set out below ('Eligible Entrants').
4. Entry is only open to Australian residents aged 18 years or over ('Eligible Entrants').
5. Employees, and their immediate families, of the Promoter, associated agencies and companies, contractors or individuals are not eligible to enter AHOS20. Immediate family means any of the following: spouse, ex-spouse, de facto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
6. The Promoter is Acer Computer Australia Pty Ltd (ABN: 78003872768) of Building G, Level 2, 350 Parramatta Rd Homebush West, NSW 2140 ('Promoter').
7. The Promoter has taken all necessary permits and approvals required to run the AHOS20.
How to enter, when to enter and number of entries permitted:
8. Eligible Entrants may enter AHOS20 during the Promotional Period (defined below) by adhering to the following entry method.
9. AHOS20 is a game of skill. To enter, individuals must visit acerhomeofficesos.com, follow the prompts on the entry page and input the requested details on the Gleam widget. Entry requires a submission of an original image and answering one question in 50 words of less [“why you deserve a home office makeover from Acer”]. Entrants must submit the fully completed entry form during the Promotional Period. Only entries that answer the question and submit an original image will be entered into the draw, winners revealed after the Promotional Period.
10. AHOS20 winners and runner ups will be determined by Acer and submitted via Gleam, which is a third-party marketing platform.
11. AHOS20 commences on 09/07/2020 and closes 31/07/2020 ('Promotional Period').
12. Only one entry per person during the Promotional Period will be permitted to participate in AHOS20.
Prize on offer
13. The prize on offer is part of a prize pool of RRP AU$6,998
14. Prizes include the following items
14.1. One winner will receive an AU$2,000 home office revamp and a 14” touch screen, Intel Core i7 Acer Swift 5 laptop (valued at RRP $1,799) and Acer KG271P 27" FHD Monitor (valued at RRP $699). The laptop will be available from Harvey Norman in Australia. The total winner prize pool is valued at AU$4,498.
14.1.1. The winner will be contacted via email and awarded a total of $2000 to spend at the following selected retailers; Freedom Furniture, IKEA, Kmart, Harvey Norman. Winner is to only select items from the home office category i.e. desk, lamp, plants, desk chair, lighting, stationery, and laptop stand, etc… Winner is to manage budget to the total of $2000. Winner to share links of selected items via email with Acer to organise delivery and purchase.
14.1.2. Winner to share photo of final set up of new space, to be used across Acer’s social channels.
14.2. Five runners-up will receive a gift card voucher from Harvey Norman valued at AU$500 each. The total runner-up prizes are valued at AU$2,500. Gift card prizes will be delivered by email.
15 The winners and runners-up will be contacted and announced via Acer ANZ Instagram page and acerhomeofficesos.com within the first working week at the end of the promotional period (Week commencing 03/08/2020).
16 If the Promoter is unable to contact a winner or runner-up to claim fulfilment of the promotional prize, that winner or runner-up will forfeit the prize in its entirety, and it shall be awarded to the next runner-up in the promotion. The Promoter will not be liable for a winner or runner-up who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.
17 Unless expressly stated in these Terms and Conditions all other expenses are the responsibility of the winners and runners-up (and their companions) including but not limited to current spending money, transport to and from departure and arrival points, transfers, meals and drinks (excluding dinner voucher), telephone calls, gratuities, services charges, and all other ancillary costs.
Further Terms and Conditions
18 The Promoter reserves the right to amend these Terms and Conditions if AHOS20 cannot be run as originally planned. The Promoter may also cancel or suspend AHOS20 if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity, or proper conduct of AHOS20. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of AHOS20.
19 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of AHOS20. The Promoter's legal rights to recover damages or other compensation are reserved.
20 The promoter highly recommends current and correct email address to be provided for each of the prize winners and runners-up for ease of correspondence and information transfer. The Promoter makes all reasonable efforts to transfer prizes to the details provided by competition entrants.
21 The Promoter reserves the right to request winners and runners-up to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner or runner-up cannot provide suitable proof, the winner or runner-up will forfeit the prize in whole and no substitute will be offered.
22 The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner or runner-up, being unable to satisfy these Terms and Conditions.
23 The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner or runner-up. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.
Privacy Collection Statement
24 The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use, and handle PI as set out in its Privacy Policy, which can be viewed at Acer Privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt-out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
25 The winners and runners-up permit Acer Computer Australia Pty Ltd to use their name, details, any digital content from AHOS20 across social media during and post the AHOS20.
Copyright, Statutory guarantees, Waiver and liability
26 In participating in AHOS20, entrants, with during and post-campaign consent, agree to participate and co-operate as required in all editorial activities relating to AHOS20, including but not limited to being interviewed, videoed, and photographed. Entrants also agree to grant the Promoter a perpetual and non-exclusive licence to use such content, footage and photographs in all media within Australia, including online social networking sites, and entrants will not be entitled to any fee for such use.
27 Prize winners and runners-up are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
28 Nothing in these Terms and Conditions limit, exclude, modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
29 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner, runner-up or Entrant; or (f) use of a prize.
