Entry is open to Australian residents aged 18 years and over who are subscribers to the Sherman monthly newsletter. To enter the Promotion, entrants must be a current subscriber or sign up as a subscriber within the promotional period. One (1) winner will be drawn on 18 June 2022 and will be notified by email within two business days of the draw. The Prize is for 1x King mattress plus 1 x Queen mattress of any feel within the Sherman mattress range. The Prize is not exchangeable and cannot be taken as cash. Delivery of the prize will be arranged to one address only within our current delivery zones. Please note that we cannot deliver to all areas of Australia. Below you will find our Terms & Conditions. We encourage you to read and understand these terms as well as our Privacy Policy and Website Terms Of Use. These govern how we interact with you, our terms of sale of our products and our commitment to you with regards to maintaining your privacy and your consumer rights. This sets out how we collect and manage your personal information and also our expectations of your behaviour when viewing this site and when purchasing from us. This is intended for Australian residents only and does not apply to viewers outside of Australia.
Officially, we are Sherman Australia Pty Ltd (ABN 38 631 087 584), but we refer to ourselves in the following as “We” and “Us” and we refer to our property, rights and obligations as “Our” or “Ours”. We talk about you, our customers and viewers as “You”.
Ordering
An order placed on this site is subject to these terms and conditions. We will acknowledge your order with a follow-up email, however this email is not a confirmation or order acceptance by Sherman. Order acceptance and the contract completion between you and us takes place only on the dispatch to you of the products orders. Otherwise, we will notify you that we will not accept your order or have cancelled your order in a timely manner.
As we do not give you access to your order once submitted, we request that you print the order acknowledgement email you receive for your own records. If you wish to obtain details of your previous orders, please contact our customer care department at hello@sherman.com.au
Delivery & Collection
It is entirely your responsibility to ensure correct delivery details and information regarding access to your delivery address are provided to Sherman at the time of ordering. If you choose to collect products from our third party logistics warehouses, it is entirely your responsibility to ensure that you are able to safely and securely pick up and transport the products to your destination.
At the time of your order acknowledgement email. Sherman will offer a delivery day and an estimated delivery time frame of between 3 hours for most metro deliveries but up to 12 hours for deliveries made by a third-party transport provider. We make every effort to have products delivered or have products available for collection within this time frame, however delays are occasionally caused by unforeseen circumstances. You agree that Sherman is not liable for any loss incurred if the products are not delivered or available for collection within the estimated time frame. At the time of your request for a mattress collection and refund, we will offer you a delivery day and time frame at our earliest opportunity. We reserve the right to prioritise new order deliveries ahead of collections of mattresses for refunds. Therefore, at times of high demand, a mattress collection can be delayedand we will not be liable for any loss incurred or inconvenience caused by this delayed collection date.
Once the delivery day and estimated delivery time frame have been agreed upon, you agree that a responsible person aged 18 years or over will be at your place of residence at the time that we attempt delivery. If you are not able to take delivery within this agreed time frame, you will notify us with more than 2 hours notice and we will reschedule a new delivery day and or estimated delivery time frame. If you are not at home when we attempt delivery and/or attempt to collect your mattress for a refund, and have not made any attempt to let us know before 2 hours before the agreed estimated delivery time frame, we will charge you a missed delivery fee of $99.
When an order is placed with us, you must let us know if you are not able to take delivery or collect the products within 30 days from the day that we notify you that they are available.
Risk of loss and damage of products passes to you at the time of delivery or by you collecting the products.
Payment
We take payment at the time that we receive your order based on the payment method of your preference. If we are unable to supply these goods we will inform you as soon as possible and a full refund will be issued to you where you have already paid for the goods.
Sherman make every effort to ensure that the prices for goods displayed on the site are accurate, however errors may occasionally occur. In the event of a pricing error, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling the order. If we are not able to contact you, we will assume that you wish to cancel the order. If the order is cancelled after a pricing error, you will receive a full refund where you have already paid for the goods.
Payment can only be made by the methods specified on the website.
Title to any products that you order on the website shall pass to you upon delivery of the products or upon you collecting the products only once we have processed and received full payment for the products.
All prices shown are in $AUD and include GST (where applicable) but exclude assembly charges and delivery charges for delivery outside of our free delivery areas. During the order, you can find details of our free delivery areas once you enter the delivery suburb and postcode. Assembly and/or delivery charges are shown in $AUD and include GST (where applicable).

Sherman offers a guarantee for the benefit of the original purchaser of the product only and is not transferable.
