Participation in the newsletter can be terminated at any time through a link at the bottom of the newsletter. Potential Winner Selection: Potential winners will be selected based on the criteria defined at the beginning of the Giveaway. The potential Winner will be notified by e-mail and will be required to respond within the allotted time to claim their prize. The winner may be required to complete, sign, and return to Sponsor an affidavit of eligibility, a waiver of liability, and (where legally permitted) a publicity release within three (3) days of issuance of prize claim, or prize may be forfeited and offered to an alternate potential winner. Prizes: Odds of winning a prize are determined by total number of eligible entries received. The more actions you complete, the more entries you receive. The person with the highest number of entries has the highest chance of being chosen as a winner. The winner is chosen at random through Gleam's application. 1 winner will be drawn and contacted within 7 days of the Giveaway end date. Limit one prize per person, household, IP address, and/or email address. Sponsor reserves the right to substitute prizes of equal or greater value at Sponsor’s sole discretion, or to end a Giveaway due to lack of participation.
All taxes are the responsibility of the winner, and the winner will be required to send Sponsor a signed and current IRS form W-9 for tax purposes related to the receipt of any such prize.
Times of Travel: Winner must travel between January 1, 2019 - December 31, 2019. The Laylow Waikiki hotel will accommodate the winner and their guest within those dates, however there is no guarantee of availability at a given time. It is the guest's responsibility to communicate with The Laylow Waikiki to determine availability prior to booking air travel.
Booking: The winner must book both airfare and accommodation at The LayLow Waikiki by January 31, 2019.
Airfare: Waiakea will provide a gift card, or other acceptable form of payment, to the winner's airline or third-party booking site of choice of up to $1,200 USD to cover costs of two (2) roundtrip flights, departing from winner's origin city and arriving in Honolulu, Hawai'i, with the return. In the case that the flights cost more than $1,200 USD, Waiakea will not provide additional funds and it will be at the winner's responsibility to cover any additional costs or fees. In the case that airfare for two (2) roundtrip flights, departing from winner's origin city and arriving in Honolulu, Hawai'i with the return, costs less than $1,200 USD, Waiakea will provide a gift card for the exact cost and no more.
The prize is non-transferable, non-refundable and no cash alternative will be given. Waiakea accepts no responsibility for any tax implications that may arise from accepting a prize and recommends that all entrants obtain independent financial advice in this regard. If any act, omission, event or circumstance occurs which is beyond the reasonable control of Waiakea and which prevents Waiakea from complying with these terms and conditions, Waiakea will not be liable for any failure to perform or delay in performing its obligations. International winners (including EU regions) will be responsible for VAT, duties or import fees on the shipment of their prize. Due to customs requirements, the prize will need to be assigned a value of at least $1.00 USD. (If we do not, then your customs office may elect to charge you the retail worth of your item.) Further, some countries outside of the U.S. do not have reliable mail services. In the event that a prize has been stolen or mishandled during shipment to an international destination, Waiakea may not be able to replace the specific item(s). If the winner prefers a specific quicker shipping method, they are responsible to notify us immediately and will also be responsible to cover the additional costs, if any.
