The Finest Wedding promotion (Promotion) is subject to the following terms and conditions:
Promoter The Promoter is Thomas Jewellers (Aust) Pty Ltd, ABN 23 005 629 396, (Thomas) c/o GPO Box 2234 Melbourne Victoria 3001.
Terms and Conditions of entry By completing the process at the promotion link on the Thomas website https://win.thomasjewellers.com.au/, (Website) the entrant accepts these Terms and Conditions of entry.
Who can enter? The Promotion is governed by the relevant state laws of Australia. Entry is open to all residents of Australia who are over the age of 18 and not already legally married. This Promotion is not open for ‘vow renewal’ couples. Regardless of any future changes to the Marriage Act legislation, same sex couples are entitled to enter and will be eligible to win, provided they are not already legally married. Employees of Thomas and their associated agencies are not eligible to apply. Any eligible entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
How to enter? Thomas accepts no liability for any applications that failed to successfully process due to technical difficulties associated with the entry mechanism, Illegible and/or incomplete applications will not be accepted. Main Prize: Entrants must submit an entry on the Website by filling in the online entry form and uploading an original photographic image (Works) featuring themselves and their partner. An individual may only enter once, hence a couple may be featured twice if each partner has separately submitted a valid entry. A moderation process combining review for valid email addresses, assessment of IP address(es) used, originality of the Works and suitability of the entry will be applied by Thomas before an entry is made live on the Website. Once an entry is live on the website it will have its own entry profile page (Entry) and the link for the Entry will be sent to the entrant via the supplied email address. The eligible Entry that receives the most valid public votes by the end of the Promotion will be deemed the winner. Entrants may actively seek votes from family and friends by sharing their Entry page including using share methods provided on the Website. Voter Prizes: Entrants must complete an entry on the Website by filling in the online form in order to vote for their favourite couple. Each Entry page has an entry form which constitutes a vote (Vote) when successfully completed. An entrant may Vote for each Entry once only, but may Vote for as many different Entry pages as they like. Each valid Vote is entered into the draw for the Voter Prize Pool.
Dates of Promotion The Promotion opens 18th September 2017 at 9am and closes 30th November 2017 at midnight AEST. Any entries received after the close date will not be considered.
Judging the entries The Promotion is a game of skill and chance plays no part in determining the winner. All final decisions by Thomas in relation to this Promotion including, but not limited to, the selection of winners and distribution of prizes, is final and binding, and no correspondence shall be entered into. Main Prize: at the end of the Promotion, the eligible Entry with the most valid Votes will be deemed the winner of the main prize. The Entry with the second highest amount of valid Votes will be deemed the winner of the first runner up prize and the Entry with the third highest amount of valid Votes will be deemed the winner of the second runner up winner. Voter Prizes: The Voter Prize recipients will be judged by a board of Thomas representatives, based on the judge’s personal opinions as to the Votes they deem most creative, worthy and, where appropriate, aligned to the Thomas brand values. The Thomas values are: Beautiful Perfection, Modern Worldliness, Intimate Storytelling and Sophisticated Artfulness
Prize Pool Prize elements are non transferable and not redeemable for cash.
Main Prize Pool: Main Prize consists of: – Diamond rings and jewellery to the value of $20,000 from Thomas Jewellers, as chosen by the winner, which will administered in store or by phone / email – Wedding planning & styling by LENZO valued at $10,000, with LENZO to facilitate styling from implementation to full delivery, including concept and coordination with suppliers – Wedding dress from Anna Campbell up to the value of $3,000, as chosen by the the winner which will be administered in the showroom or by phone / email – A wedding photographer valued at $3,000 will be appointed to the wedding, chosen by Thomas and LENZO from our wedding supplier partners, the final selection of the wedding – Venue and catering up to the value of $15,000, chosen by the winner from our selection of wedding supplier partners, dependent on the date and location of the wedding – All prizes are subject to availability and each prize supplier is providing their portion of the Main Prize with their own usual retail trading terms, including refund and return policy where applicable – Once suppliers / orders have been confirmed, if the value of any prize element comes in below the RRP value stated in the prize pool, the winner will not be reimbursed for the outstanding amount – If the winner wishes to, they can pay the retail difference to cover additional costs to secure more product or services from the prize suppliers, at their own discretion – The winner has until 31/12/18 to redeem their various wedding prizes, unless otherwise negotiated, at the sole discretion of Thomas – The products and services forming the prize have been agreed in good faith by Thomas with the suppliers of the prizes. Thomas accepts no liability or responsibility for the provision of, or failure to provide, products and / or services from specific suppliers – If the main prize winner cancels the wedding before the event, the prize is not redeemable for cash. In the event of a cancellation, Thomas will contact the first runner up and offer the prize elements in whatever progress state had been achieved prior to the cancellation. They will have the opportunity to take up the bookings and orders already in place, as well as the balance of any other prize elements still to be confirmed. The first runner up will have first right to the prize, followed by the second runner up, should the first decline. Should the second runner up decline, Thomas will contact the next runners up in order of highest eligible votes until a new winner accepts the prize. If a suitable winner cannot be found prior to the wedding bookings already in place, then Thomas, at its sole discretion, will cancel the wedding without replacement. First Runner Up Prize consists of: – A $2,000 Eternal Fire voucher from Thomas Jewellers, which the winner can choose to spend in store or via the online store, valid until 31/7/18 Second Runner Up Prize consists of: – A $1,500 Eternal Fire voucher from Thomas Jewellers, which the winner can choose to spend in store or via the online store, valid until 31/7/18 Voter Prize Pool: Main Voter Prize consists of: – Either a $1,500 diamond pendant or a $1,500 watch from Thomas Jewellers, the winner can choose which to receive, which will be administered in store or by phone / email, valid until 31/7/18 Weekly Voter Prizes consist of: – 10 x $100 vouchers from Thomas Jewellers , which the winners can choose to spend in store or via the online store, valid until 31/7/18
Eligible Entries By submitting an entry, the entrant warrants that it has the power and capacity to agree to these terms and conditions of entry and the Works are the original works of the entrant, developed for entry into the Promotion. The entrant understands and acknowledges that Thomas intends to edit, reproduce and market the Works for commercial purposes. The entrant agrees to assign all rights in the Works to Thomas and irrevocably consents to Thomas or its agents or contractors doing any act or making any omission which may otherwise infringe their moral rights under the Copyright Act 1968 (Cth). The entrant warrants that the Works do not infringe any laws or the rights of any third party and that Thomas’s intended use of the Works will not infringe any laws or the rights of any third party. The entrant warrants that it has the rights to give consent, including giving consent on behalf of all parties featured in the Works, to the reproduction and publication of the Works. The entrant agrees that where necessary, it has taken the opportunity to have independent advice in accepting the terms and conditions of entry into the Promotion. All entries must be made directly by the entrant, and use of a false name or address will result in disqualification. All products and services offered as prizes under the Promotion will apply to bona fide weddings arranged and taking place within the time frame specified. Thomas reserves the right to ask entrants, or for their agents to ask entrants, for evidence to verify the legitimacy of an Entry or Vote. Prizes may be withheld until this verification has been satisfactorily completed. Failure to provide satisfactory evidence may result in disqualification of an Entry or Vote.
Acknowledging and promoting success Entrants acknowledge and agree that Thomas may publish the details of the successful recipients including photographs and videos, either submitted as the Entry or taken by Thomas or their associated agencies.
This includes photographs and videos from the winner’s wedding day and associated planning sessions, behind the scenes and post wedding activities. Specifically, the winning wedding will be featured in the LENZO blog post which will include a write up on the couple, their planning process and final wedding details. It is a condition of accepting the prize that the winner and their guests may be required to sign a release form, as determined by Thomas, at its discretion prior to administering the prize. Details of the winners, photographs and videos may be used in Thomas marketing and press releases and may be subsequently featured in public mediums including, but not limited to, newspapers, online articles, blog posts and social media posts. Entrants acknowledge that Thomas has limited control on editorial content published by third parties.
Contacting final recipients The recipients will be notified by 8th December 2017 via a published announcement on the Website and / or Thomas social media channels, and by email or message to the email or telephone number submitted with the entry via the entry form on the Website. The successful winners have until 15th December 2017 to contact Thomas to claim the prize. Failure to claim the prize by 15th December 2017 means the terms of the prize will lapse and new recipients may be selected. Weekly Vote winners will be notified by the Tuesday in the week following.
Personal Information The recipient acknowledges that it provides certain information on the application form to be used by Thomas for future promotional purposes. Individual’s personal information cannot be disclosed without the individual’s consent. Personal information will be handled according to the Thomas Privacy Policy which can be viewed here.
Promoter’s rights reserved The Promoter reserves the right to exercise its absolute discretion in excluding entries that it considers to be offensive or contrary to law. Thomas reserves the rights to amend these terms and conditions at any time, without prior notice. Any amendments will be published on the Website. You are advised to check the website regularly for any changes.
General release The Promoter accepts no responsibility for any tax liabilities that may arise from an eligible entrant winning a prize in the Promotion. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, loss revenue or profit) or personal injury suffered or sustained in connection with the Promotion or accepting or using a Prize. The Promoter accepts no responsibility for any variation in the value of a prize offered in the Promotion. If, for any reason whatsoever, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other cause beyond the control of the Promoter which could corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoter reserves its right in its sole discretion to take any action that may be available, subject to State and Territory regulations.
